PORT OF SPAIN, Trinidad -- In addition to a renewed focus by US authorities on the reasons for the failed extradition and prosecution of two local businessmen accused of bribery and corruption, the former Trinidad and Tobago government, led by Kamla Persad-Bissesssar, may face awkward questions concerning an alleged drug trafficker wanted by the Drug Enforcement Administration (DEA).

Dev Harrilal Maharaj, who appears on the DEA’s list of most wanted Caribbean fugitives, has reportedly claimed to have paid almost US$200,000 to officials in Trinidad to turn a blind eye while he moves and drives around openly in the Maraval area of the island in a new model BMW X5, licence number PDB5300.

This information was relayed to the DEA and the US Department of Justice (DOJ) as long ago as May 2014 but little, if any, action seems to have been taken. An email enquiry to the DOJ for comment was referred to the DEA, who did not respond to phone calls.

In July, Jack Warner, whose extradition to the US from Trinidad is currently being sought to answer multiple counts of racketeering, bribery and money laundering, claimed that, in the run-up to the May 2010 general election, he witnessed Persad-Bissessar accepting TT$8.3 million (US$1.3 million) from local businessmen Ish Galbaransingh and Steve Ferguson in exchange for legislative protection against extradition and prosecution.

Following the victory of Persad-Bissessar’s People’s Partnership coalition in the 2010 elections, new legislation was passed in 2012, the infamous Section 34 of which effectively allowed Galbaransingh and Ferguson to escape prosecution in Trinidad and Tobago for the same alleged offences for which their extradition had been sought by the US.

A public outcry forced the Persad-Bissessar government hurriedly to repeal Section 34 retrospectively but ongoing litigation as to the constitutionality of the reversal reached the Privy Council in London last week. After a three-day hearing, the Judicial Committee said it would take time to consider its decision.

Warner’s claims of corruption within the previous government are currently being looked at more closely by the DOJ and, according to US sources, Warner may be trying to use what he knows as part of negotiations for a possible plea bargain. Late last month, the extradition hearing in Trinidad in relation to Warner was postponed until December 2, after his attorneys requested more time so they could travel to the US and discuss extradition terms.

Meanwhile, Persad-Bissessar’s United National Congress (UNC) will hold internal elections on December 5 at which all positions will be contested, including that of political leader, a post Persasd-Bissessar has held since January 2010.

Persad-Bissessar’s leadership of the party is expected to be challenged since, after winning the May 2010 general election, she led the UNC to a series of defeats, culminating in her government being ousted from office in the general elections on September 7, 2015.

She launched her campaign for re-election as UNC leader on Saturday afternoon at a public meeting in Penal, with the slogan “Who vex loss, Kamla ‘is boss’”. However, a number of senior UNC members of parliament were conspicuous by their absence from the event.

According to local reports, former ministers Vasant Bharath and Dr Roodal Moonilal have both been approached by party insiders to contest the leadership. Support for Barath is said to be growing as he is perceived to be the one with the most integrity among the three.
