We don't even need to get into the details of it...An act of God is an unforeseeable natural phenomenon......it's a fact that if you have a big enough tree, leaves,branches and maybe even the tree will fall eventually and may cause injury,damage or death.

Lightning,earthquakes and floods are Acts of God.
Having a tree that was supposed to be maintained fall and kill somebody because it was not maintained is neglect.
