CCN pleads not guilty

Tuesday, May 15 2012

Caribbean Communications Network (CCN) has pleaded not guilty to three charges slapped against them, following the airing of a rape tape last year.

The company, through its attorney Senior Counsel Sophia Chote made their plea known via a letter to Chief Magistrate Marcia Ayers-Caesar.

When the matter was called before Ayers-Caesar in the Port-of-Spain Eighth Magistrate’s Court yesterday morning, Chote said her client will be pleading through their legal representation.

Chote then indicated to the court that CCN, via a letter, listed their pleas to the three charges under the Sexual Offences Act.

Police prosecutor Sgt Rickey Lochan asked the court for a short adjournment since, according to him, the proper representation needed to be made on the State’s behalf.

Lochan said a short file had already been compiled and submitted to the Office of the Director of Public Prosecutions and he is awaiting word on the relevant State attorney who will prosecute the matter. The matter was then adjourned to June 26, for mention.

CCN and Crime Watch host Ian Alleyne are charged under the Sexual Offences Act. Alleyne is currently on $80,000 bail and faces three charges of breaching Section 32(2) of the Sexual Offences Act for allegedly airing on the CCN television station, TV6, on October 25 and 26 last year, a tape of a minor being raped. He’s also charged with resisting arrest.

When the matter was called, Alleyne, through his attorney Om Lalla, pleaded not guilty to the charges.

The talk show host was arrested and subsequently charged during an exercise headed by Sgt Ajit Persad last month on the compound of Express House, while CCN was charged via summonses.

Busby appointed to prosecute CCN
By Rickie Ramdass rickie.ramdass@trinidadexpress.com

Story Created: Jun 26, 2012 at 10:57 PM ECT

Story Updated: Jun 26, 2012 at 10:57 PM ECT

SENIOR State attorney George Busby has been appointed by the Office of the Director of Public Prosecutions (DPP) to prosecute the matters brought against CCN TV6 and Crime Watch host Ian Alleyne.

Yesterday, Busby made his first appearance in the matter before Chief Magistrate Marcia Ayers-Caesar in the Port of Spain Eighth Court.

When the matter came up for hearing shortly after 9 a.m., Busby told the court he was made aware that an application was made by attorneys for the television station that no representative from the company be required to attend court, but instead do so through their attorneys.

That application was made via documents to the court on the last occasion the matter was called before Ayers-Caesar on May 14.

Busby questioned why this was done in the absence of a State-appointed attorney, and asked that the magistrate reconsider the decision to have the company appear through its attorneys.

He said he was only recently made aware of the application and needed additional time in order to peruse the authority.

Lead defence attorney for CCN TV6 Sophia Chote SC said on the last occasion the matter was called, a copy of the authority was given to the police prosecutor and she was of the opinion that it would have been passed to whoever was appointed by the Office of the DPP.

The television station which is facing nine charges is also being represented by Michelle Solomon-Baksh and Trevor Clarke.

Attorney Om Lalla is seeking the interest of Alleyne.

The company is charged alongside Alleyne with breaches of the Sexual Offences and Telecommunications Authority acts, relating to the broadcast on three separate days last October of a video showing the rape of a minor.

Alleyne, who is currently on $80,000 bail, is facing three charges contrary to the Sexual Offences Act and one charge of resisting arrest.

He first appeared in court on April 24, after being arrested at Express House, Independence Square, Port of Spain five days earlier. CCN TV6 was served with the criminal charges on April 23.

The matter will continue on July 16.

Dec 13 — trial date for CCN, Alleyne

By LAUREL V WILLIAMS Wednesday, October 10 2012

CHIEF Magistrate Marcia Ayers-Caesar yesterday set December 13, as the date for a trial to begin against both the Caribbean Communications Network (CCN) and Crime Watch host Ian Alleyne.

Ayers-Caesar made this announcement when Alleyne re-appeared before her in the Port-of-Spain Eighth Court. Shortly after the case was called, State attorney George Busby told the court that he wanted her to set a trial date.

Busby noted that there was only one outstanding document to disclose and this should not prevent her (Magistrate Ayers-Caesar) from setting a trial date.

Alleyne, the host of a local show aired on CCN’s television TV6, is charged with three offences under the Sexual Offences Act and with resisting ASP Ajith Persad in the execution of his (Persad) duties.

CCN TV 6 is also slapped with three charges under the Sexual Offences Act and six under the Telecommunications Act.

The charges against Alleyne and CCN stemmed from the alleged airing of a video which purportedly showed a minor being raped. The video was broadcast on several days.

ASP Persad, of the Port of Spain CID laid the charges. Alleyne is represented by Om Lalla and Derrick Balliram, both of whom were present in the courtroom yesterday. CCN is represented by Sophia Chote SC, Michelle Solomon-Baksh and Trevor Clarke.

Clarke yesterday apologised for the absence of Chote and Solomon-Baksh, both of whom he said were in another jurisdiction.

Ian Alleyne guilty

By JADA LOUTOO Thursday, March 7 2013

TV6 Talk show host Ian Alleyne yesterday pleaded guilty before a Port-of-Spain magistrate to charges laid against him under the Sexual Offences Act, namely, revealing the identity of a rape victim during a “live” broadcast in October, 2011.

http://www.newsday.co.tt/news/0,174472.html

Alleyne, however, maintains his not- guilty position relating to a charge of resisting arresting officer ASP Ajith Persad in the execution of his duties.

Section 32 (2) of the Sexual Offences Act reads: ‘A person who publishes or broadcasts any matter contrary to subsection (1) is guilty of an offence and liable on summary conviction to a fine of $25,000 and to imprisonment for five years.

Subsection (2) refers to — (a) in the case of a publication in a newspaper or periodical, any proprietor, any editor and publisher of the newspaper or periodical; (b) in the case of any other publication, the person who publishes it; and (c) in the case of a broadcast a body corporate, which transmits or provides the programme in which the broadcast is made and any person having functions in relation to the programme corresponding to those of an editor of a newspaper

CCN is represented by Sophia Chote SC, Michelle Solomon-Baksh and Trevor Clarke. Alleyne was also represented by attorney Derrick Balliram while Simone Jaggernauth assisted Busby in the prosecution.

I don't care of the outcome, but did the rape suspect case get this much attention? Is it even closed? I mean the justice system needs to start to prioritize and the criminals trials should be expedited. Not for just high publicity cases. Real criminals are roaming

It is a summary offence.. Magistrate can reprimand and discharge him or hit him a small fine. I doubt he'd get jail

I remember the vid.
When I first saw it I honestly saw nothing wrong with it...can't remember the thought of it being illegal running through my mind.
The man and the girl were both fully clothed and he simply showed him dry humping her...is not like if they were both nude or anything...
