Father gets 20 years for raping daughter

FIFTY-SEVEN years hard labour was the sentence passed on a remorseless father who raped and assaulted his child when she was 11-years-old.
Justice Devan Rampersad handed down the punishment yesterday in the San Fernando Fourth Criminal Court after a jury convicted the man last Monday on four sex crimes.
The girl, now 19 years, testified against her father.
The court heard that during one of the acts he placed a pillow over the child's head and threatened to kill her if she confessed.
It was back in 2003, after returning from a Easter family day, the former Caroni (1975) Ltd worker grievously assaulted his daughter sexually.
One week later he had sexual intercourse with her and again months later.
A fourth act of incest occurred two years later when the girl was a teenager.
This time the girl's mother had spent the night at the hospital with an ailing son.
The man was warned by his wife to leave the house before she went to the hospital.
Instead, he stayed and had sex with the girl, placing a pillow over her head during the act.
State attorney Shabana Shah yesterday said the taxi-driver, now 42, had shown "deviant sexual behaviours" and reminded Rampersad of the maximum sentence of life in prison for such offences.
She raised aggravating factors including the difference of age between victim and perpetrator — the prisoner was 35-year-old at the time —the nature of the crimes, the violence the victim had endured, the threats made on her life, that the offences occurred repeatedly, and the trauma of having to give evidence.
Shah also said that public confidence should be maintained in the justice system and that society and members of the family needed to be protected.
The man had one previous conviction back in 2003, fined for breaching the protection order taken out by his wife.
Defence attorney Michael Rooplal asked for counseling and rehabilitation for the prisoner.
He said this will go further than passing the maximum sentence.
He told the court, "There have been no indication of remorse from instructions received from the accused."
Rooplal also said his client suffered from diabetes and hypertension and had heart problems.
But Shah said these were illnesses for which he could receive treatment while in jail. She said treatment had already been given during the five years and one month he had been awaiting trial.
The man was charged with multiple sex offences in 2003 and granted bail.
While on bail, he raped his daughter again and this time was charged and refused bail.
Mohammed said he took the jail time into consideration and said rehabilitation could be done through the Prisons Service.
For committing rape in 2005, he was sentenced to 20 years in prison.
On the two charges of having sexual intercourse with the girl, he was sentenced to 15 years each.
He was also sentenced to seven years hard labour for the 2003 act of grievous sexual assault against the child.
The sentences are to run concurrently. He will serve 20 years in prison.
The father had faced a fifth charge of sexually assaulting a younger daughter by biting her on her genitals. This charge was dismissed after the jury found him not guilty.

Doh geh tie up or offended eh but this kinda thing very common in the country side/rural areas especially amongst east indian folk. Some fathers are of the belief (i heard this for myself) that they made their daughters so they should be the ones to fcuk them and not another man.

The mothers are usually too weak, ignorant, illiterate and subservient to their husbands so they do/say nothing about it. I am pretty sure while i typing this some father in the bush is having sex with his daughter.

It's a very serious social problem we are facing. The level of illiteracy in trinidad is amazing.

I knew a guy who was a mechanic and used to drive taxi also. This was some years ago and he had 5 daughters, I remember him telling another taxi driver that he does take all he daughters virginity because he make them so he could break them.

Everyone of he daughter run away with some man and quit school.

I tried to convince the man what he doing was wrong and his response was

"Aye boy you hush yuh mouth you eh have daughters so you won't know, one day when you have a daughter then you go understand"

Well boy that was the end of that.
