wtk: reporting an illegal construction

Postby ismithx » April 12th, 2011, 7:50 pm

I just want to know, who do you call in the case that someone does an illegal construction. In this case, they are putting up a wall that blocks your view as you turn into a main road. its really irritating and i eh playing this time.... reporting them same week i see the thing....

I think that there is a rule which states that your fence must be about 15ft from the road...

if the wall does not exceed 7 feet there is no need for town and country approval as for the fence line distance to the road I do not know what is the requirement

well is best i explain some more. There is the pavement, then there is the wall. the wall stops literally right where the pavement begins. so that you have to bring out the car a little more in order to see what is coming on the right side. Also a lot of cars park right near to the corner, on the main road, so it is difficult to see the oncoming traffic because the wall blocks where you would normally peep... some trinis real annoying eh..

As long as the wall is being built along the property boundaries (as defined in the property's cadastral survey), then it should be legal. The offset from the boundary that people are talking about here is the building offset which varies depending on what is to be built.

Your real problem is with the cars that are illegally parked near to the corner. IIRC, the minimum distance that cars should be parked from a corner is 9 metres.

Any construction should be approved by the Regional/Municipal Corporation. So, if the proposed construction was not approved by the Corporation, then they have the authority to put a stop to it until the relevant approval has been granted.

Reminds me of the corner of the SMR and Citrus drive in Enterprise.

This has traditionally been a tricky problem. In fact property owners are well within their rights to build on their properties once the off-sets as noted before in this thread are complied with.
The state on the other hand is supposed to have well defined road-reserves which in principle should address the requirements to allow road users the safety factor to deal with issues as identified in this thread.
The reality is that over time the road-reserves determined many moons ago are no longer relevant to todays standards (they are too narrow) and the only way out is to redefine same and use the compulsory acquisition act.The work and will required to do this you will not find.
