Summons for driving without permit - Update - New Question

has anyone ever received a police summons to appear in court for driving without a permit?

what happened?
did you have to pay? if so how much?

forgot my license home one day and police pulled me over... received the summons yesterday....

also if they did not personally give me the document do i still have to go to court. it was left with someone at home to pass on to me.

As long as the summons was delivered to "an adult" at the address on your driving permit/residence you should go to court.

Just walk with your permit to show that you do have one.What they charge you for exactly..You can plead guilty and explain that you did not have omn you at the time owing to some emergency..

Possible fines may range from $200.00 to $2,000.00 or even no fine at all..

Whatever happened to the 24 hour period to produce a valid licence in such a situation? Or was that just talk and not fact?

u may be required to pay a fine or disqualification for a week or two at most...

just expalain to the Magistrate the circumstances under which u forgot it. may not be disqualified...

and yes leaving a summons at home with an adult relative constitutes good service.

You were supposed to present your permit to a police station within 24hrs after the incident, for you to get a summons is kinda serious.

well when the police asked for it i told him i forgot it at home and i can have someone bring it for me.

he then asked where i live and said i would receive a summons to go to court and let me on my way....... i was in a hurry to get home so i get left when he said i can go.

on the summons it states "failure to produce drivers permit to uniformed police officer"

NOT fact
the law requires you to have your permit on your person once driving...hence the name PERMIT
the 24 hour thing is totally at the discretion of the officer (ie ah bligh) but legally once u don't have it on your person, you in trouble

Rodn3y, attend court, inform the Magistrate of the circumstances, I have a feeling you will be reprimanded and discharged, my advice is seek legal counsel for advice on how to proceed, my reason for saying so is the FACT that driving without a Driver's Permit is an arrestable offence, the FACT that the Police allowed you to leave and not arrest you is tantamount to the Officer allowing the offence to continue, by all means attend court and get some sound legal advice beforehand

that happens to me all the time :lol:

but seriously though driving with out a permit is like driving without you actually having a license be it home or not.

so Rodn3y i think you should attend court because if you don't you will only be digging yourself deeper into SHlT. because now you will not only be facing the problem at hand presently; you will also be faced with another summons or police knocking at your door to take you to court.

the legal advice might cost more than the fine, the fact that the officer let you leave without arresting you means that he gave you a bligh cause he could arrest you and have you spend the night in a cell and appear in court the next day, count your blessings.

dan a while back i get summons for worse dan that n jus had to pay $300 jus be real wit the judge n u wont have to pay nun..... i didnt have insurance in my car n my permit was expired

go to court, plead guilty, i serious, went in for that already ...... the judge wil give you the amount of the fine to pay, he most likey he will ask when can you pay the fine say now he most likly will give you three days, go pay the fine and get the hell outta there.....i'm serious!!!! doh play with court and de law homie de pokie aint de hyatt!! 0X

CHAPTER 48:50

PART IV

DRIVING PERMITS

Driving without a permit, an offence. [12 of 1961 19 of 1978 *14 of 1979 25 of 1997].


42. (1) Save as in this section provided, no person shall drive a motor vehicle on a road unless he is the holder of a valid driving permit for a motor vehicle of that class, and no person shall employ any person to drive a motor vehicle on a road unless the person so employed is the holder of a valid driving permit for a motor vehicle of that class, and if any person acts in contravention of this provision, he shall be liable to a fine of five hundred dollars or imprisonment for six months: Provided that if the driver of the vehicle has never been the holder of a valid driving permit or has been previously refused a valid driving permit or is disqualified from holding or obtaining a valid driving permit, he may be arrested forthwith without a warrant and he shall be liable to a fine of one thousand dollars or imprisonment for one year.

In Canada and some of the states, but if its your "local" police you can use any id jus to show you are who you say you are and they can verify if you have a drivers in good standing....

ok so i need some clarification from a legal mind here: exactly what does ' the holde' of a valid driver's permit mean? To the average man like me holder means that i have a valid permit, but just not on me at the moment; i can however, produce it at a later time. Please comment folks.

Its like ur insurance you must keep in in the car.....if a officer stop you and ask you for ur permit and insurance and you can't produce the insurance it is worse than not having ur permit. Now you don't have your permit ok you tell the officer you don't have the permit but you provide the insurance how will the officer know that you are the valid owner/operator of the vehicle?? now the 24hr's is at discretion of the officer because the officer is supposed to escort you and have the car towed of driven by another officer to the station so things could be sorted out. the car remains at the station and you come back with permit all is well.

Now if you don't come back it is now like a stolen vehicle case cause you did not come and clear your name and they will be looking for you.

^^^ dont even start with the Insurance- One of the oldest fraudulent schemes in the world.

So we orn for vision 0202- police would rather lockup a man for not having a drivers permit in their being rather than arrest a man who running around killing innocent people :roll:
