So the pnm lawyers grand charge with a contractor to sue cepep but the Judge throw out the application because there was a clause in the cepep contract stating that any dispute must go through mediation FIRST before court action. Now the contractor have to pay cepep costs.

Yuh see why Rowley hire a UNC lawyer instead to go against a UNC lawyer to win his private case? :lol:


Judge stays CEPEP lawsuit, refers fraud claims to DPP

A HIGH Court Judge has stayed a lawsuit filed by a contractor against The CEPEP Company (CEPEP) and has directed that all case documents be sent to the Office of the Director of Public Prosecutions (DPP) for investigation.

On Thursday, Justice Margaret Mohammed ruled that the claim filed by Eastman Enterprise Ltd against CEPEP was "premature."

The judge found that Eastman Enterprise Ltd had failed to comply with its contract's dispute resolution clause, which required the parties to first attempt to settle the matter through mediation.

The lawsuit was filed by Eastman after CEPEP terminated its contract on June 27. This was despite an addendum signed on April 23, just five days before the general election, that extended the contract for another three years, to September 2029.

The initial contract was to expire in November 2026.

Eastman Enterprise, represented by attorneys led by Senior Counsel Larry Lalla, was seeking an injunction to stop the termination and was also claiming damages.

In its defense, CEPEP, whose legal team was led by Senior Counsel Anand Ramlogan, argued that the lawsuit should be dismissed or stayed because the contractor had not followed the contract's condition precedent of first engaging in mediation.

Additionally, CEPEP made a serious allegation that it was "deliberately deceived" into extending the agreement to 2029. According to CEPEP, this was based on a "fraudulent misrepresentation" that the Cabinet had approved the extension, when in fact, no such approval was granted.

In her judgment, Justice Mohammed agreed with CEPEP's position. She ruled that the provision in Clause 17 of the contract was a "condition precedent" that required the parties to try to resolve disputes before going to court. The judge found that the claimant did not take all possible steps to comply with pre-action protocol.

Due to the serious nature of the fraud allegations regarding the contract extension, the judge also ordered that all documents filed in the case be forwarded to the DPP for consideration.

The final order issued by the court was that Eastman Enterprise Ltd's action and all related proceedings are stayed. The contractor was also ordered to pay CEPEP's legal costs.

Why do we have three separate entities all serving the same purpose....CEPEP, URP and Corporation. One would ask what is the role and function of each....so ok CEPEP down why the other two entities cannot pick up the slack wtf they getting paid for. Mero encouraging shite as usual I see

Good question.

Before terminating cepep contractors, regional corporations could have been prepared to take on some of those workers. Also let the regional corporations engage contractors instead like what the mayor in san fernando did.

But... if the regional corporations engage contractors instead to do the same work, do you really need cepep? Chaguanas West had 1 cepep contractor where everything else is the corporation.

Arrested, charged and out on bail for misbehavior in public office but that not happening anytime soon... that's probably 1-3 years from now. Anti Corruption Investigations Bureau of the TTPS does take long.

Now getting a conviction and jail i'm not sure. Faris and pnm's excuse is that a cabinet note is not needed since there's one from 2017 which authorizes Cepep to terminate, suspend and hire contractors. Let's say the Court proves otherwise that doesn't mean jail, as you can act on wrong advice but had no intention to be corrupt.

Faris spent 10 years and alot of money trying to get Anand lock up with email gate and Nelson Gate.
Anand won't let Faris get away with this Cepep fiasco.

CEPEP board to pursue legal action against former directors

The current board of the Community-based Environmental Protection and Enhancement Programme (CEPEP) is considering legal action against its predecessors over an alleged breach of fiduciary duty in connection with the controversial renewal of contracts on the eve of the April 28 general election.

Public Utilities Minister Barry Padarath told Guardian Media, “CEPEP’s board has consulted me, and we are looking at the liability of the former PNM (People’s National Movement) board in this fiasco.”

Padarath added, “Therefore, we intend on initiating legal action against the former PNM board with respect to breaching their fiduciary duty through civil proceedings.”

This is the latest twist in the saga involving the state company which has been the center of significant controversy, particularly involving legal action and allegations of misconduct.

A major point of contention has been the extension of over 300 CEPEP contracts for three years, set to last until September 2029. These renewals were approved by the former CEPEP board just days before a general election.

After taking office, the new government terminated the contracts, citing the absence of proper Cabinet approval for the extensions, a move that prompted lawsuits from terminated contractors, who claimed the decision was unlawful.

High Court Judge Margaret Mohammed has referred the matter to the Director of Public Prosecutions (DPP) to investigate the circumstances surrounding the contract extensions.

The court has confirmed with Guardian Media that the documents were sent electronically last Friday and received by the DPP's Secretariat.

DPP Roger Gaspard has also been asked to examine the alleged conduct of former Rural Development and Local Government Minister Faris Al-Rawi in procuring the three-year contract renewals.

Padarath told Guardian Media hat the proposed legal action against the former CEPEP board is another way the state is seeking to safeguard the taxpayer.

“While the court has moved with alacrity in addressing the matters identified by Justice Mohammed, CEPEP is also taking steps to protect the taxpayers of T&T.”

The former CEPEP board members include Joel Edwards, Yinka Jagbir-Garcia, Michael Seales, Maurissa Smith, Wendell Williams, Brian Rock, Geeta Rampersad, Robert Paul Lee, Camille Hosein, Kirt Bernard and Thomas Sanoir.

We can’t have URP, CEPEP, the highways division and the regional Corporations being paid to do the same job, and none of them are doing it correctly”

In a new chapter in the ongoing CEPEP saga, the company's CEO is being accused of omitting key information from the new board regarding its authority to renew contracts. The CEO wrote to the new chairman, citing the controversial 2017 cabinet note regarding operations at CEPEP, and said it does not give the board the authority to unilaterally approve contracts without cabinet approval. But former local government minister Faris Al Rawi says the CEO left out a major part of the note that's central to the ongoing controversy.
