this is a good case to show the difference between murder and homicide. If it was arson, it would undoubtedly be a homicide.

But did the arsonist know or could he reasonably conclude that a child might be killed by his actions? Unless this gets proven in court, it may or may not be considered murder.

I believe negligence, recklessness and intent to cause harm are all sufficient mens rea for murder. But we'll see what the courts say
