From all indications, PPP/C are the winners but GECOM has to declare. It is a matter of formality which (hopefully because is Guyana) will happen later this week.

Newsroom Guyana: The CARICOM team which scrutinised the national vote recount has said nothing prevents the Chair of the Guyana Elections Commission from declaring the results of the recount which it says reflects the will of Guyanese.

“We are…of the unshakeable belief that the people of Guyana expressed their will at the ballot box and as a result, the three-person CARICOM Observer Group concludes that the recount results are completely acceptable,” the report presented to GECOM and political leaders states.

It added: “The national recount process then, despite some of its minor flaws, is not an indictment of the 2020 polls and the team categorically rejects the concerted public efforts to discredit the 2020 polls up to the disastrous Region 4 tabulation.

“Despite our concerns, nothing that we witnessed warrants a challenge to the inescapable conclusion that the recount results are acceptable and should constitute the basis of the declaration of the results of the March 02, 2020 elections. Any aggrieved political party has been afforded the right to seek redress before the courts in the form of an election petition.”

It further added: “Overall, while we acknowledged that there were some defects in the recount of the March 02, 2020 votes cast for the General and Regional Elections, the team did not witness anything which would render the recount and by extension, the casting of the ballot on March 02, so grievously deficient procedural or technically (despite some irregularities) or sufficiently deficient to have thwarted the will of the people and subsequently prevent the elections results and its declaration by GECOM from reflecting the will of the voters. The Organisation of American States (OAS) on Monday called on the Chairman of the Guyana Elections Commission (GECOM) to declare the People’s Progressive Party Civic (PPPC) the winner of the March 2, 2020 general and regional elections in line with Caribbean Community (CARICOM) scrutinised recount and the tabulated results in the Chief Elections Officer’s report.

“OAS further takes note and wholly supports the findings of the CARICOM team of scrutineers that the results of the recount were transparent and credible, and nothing prevents the Chair of the Guyana Elections Commission from now declaring the election, based on these results.

Elections are held to determine the will of the people and once the people’s wishes are clearly stated they must be upheld – not only in instances where they favour the incumbent. In this case, the results published in the report of the Chief Elections Officer himself make it clear that the opposition PPP/C has won the favour of the majority of Guyana’s eligible voters. Their will must be respected.

The OAS calls on the current administration of Guyana to begin the process of transition, which will allow the legitimately elected government to take its place,” the 35-nation OAS states. 14 OAS members are also members of the Caribbean Community (CARICOM).

The recount shows that of the 460,352 valid votes cast, APNU+AFC got 217,920 and the PPP 233,336 and the three ‘joinder’ parties- A New and United Guyana (ANUG), Liberty and Justice Party (LJP) and The New Movement (TNM) got a total of 5,214‬ votes

Following is the full text of the OAS’ statement

The decision of the Guyana Elections Commission (GECOM), on April 3, 2020, to proceed with a national recount, and the eventual initiation of the process on May 6, were welcome developments in the ongoing electoral process in Guyana. Following the very irregular occurrences in the tabulation process for District Four, which undermined the credibility of the results for that electoral District – the largest in Guyana – a national recount of all ballots was deemed the best approach to ensure a result that was acceptable to all stakeholders.

The OAS notes that the decision to proceed with the recount had the full support of all stakeholders in the March 2 General and Regional Elections. The Official Order of the Recount, No. 60/2020, gazetted on May 4, 2020 notably states “ … the President and the Leader of the Opposition and all contesting parties agreed to a CARICOM proposal for a total recount of all electoral districts as a means of assuaging the contesting parties and determining a final credible count…” This support was reiterated in public statements by the President of Guyana and other key stakeholders as the recount proceeded.

The Order of the Recount required that “ascertained and verified” matrices of the results for each of the ten electoral districts be submitted to the Chief Elections Officer, who would then tabulate these results and submit them to GECOM, along with a summary of the observation reports prepared for each District. OAS notes that the report submitted by the Chief Elections Officer on June 13, records multiple “allegations” of irregularities by a contesting party in each District, which are then used as a basis for determining that the electoral process in each of the ten Districts was not credible. There is little evidence in the CEO’s report of efforts to investigate or otherwise address any of the alleged irregularities presented. His contention that the entire election be set aside on this basis alone is astonishing.

In its statement of April 15, 2020, prior to the commencement of the recount, the OAS had recommended the exclusion of any official who had displayed partisan behaviour during the electoral process. While the CEO’s approach to his report is therefore disappointing, it is not unexpected.

As noted in our statement of June 4, OAS observers present on each day of the national recount have reported that the process was conducted in a professional, transparent and impartial fashion, which allowed GECOM, political parties and other stakeholders to accurately determine the results for each polling station. OAS reiterates that there is no reason not to support the results of the recount process.

OAS further takes note and wholly supports the findings of the CARICOM team of scrutineers that the results of the recount were transparent and credible, and nothing prevents the Chair of the Guyana Elections Commission from now declaring the election, based on these results.

GECOM pushes back meetings to make way for Court of Appeal hearing

The Guyana Elections Commission (GECOM) has pushed back future meetings now that the Guyana Court of Appeal has set Friday to hear a case filed by private citizen whether that election management body must first decide on a “final credible count” of the votes cast at the March 2, 2020 general and regional elections.

Eslyn David is asking that the Chief Elections Officer, Keith Lowenfield be prevented from submitting that report to the GECOM Chairman, Retired Justice Claudette Singh without “determining the final credible count and or the credibility” of the polls in keeping with the national vote recount orders.

After receiving a notice of motion, Lowenfield did not submit his report.

People’s Progressive Party (PPP) election commissioners, Attorneys-at-Law Bibi Shadick and Sase Gunraj said in the absence of the Chief Elections Officer’s report, the Commission could formally declare the results. “There are laws to do whatever has to do. We will follow the law. The nation can’t be waiting on the likes of Lowenfield and them. Are we crazy? Do we look crazy. This is country is hurting and bleeding and the likes of Lowenfield is going to stop this whole thing?,” she said.

They had hoped to return on Friday to craft the next steps for the commission to possibly make a declaration with the assistance of another statutory officer, Deputy Chief Elections Officer, Roxanne Myers.

GECOM said a commission meeting scheduled for Friday has been cancelled because the Guyana Court of Appeal is Friday afternoon at 1:30 expected to hear a case filed by David.

Thursday’s meeting did not have sufficient representatives to meet and make decisions even without a report of the election results by the Chief Elections Officer, Keith Lowenfield.

The meeting did not have a quorum because only one pro-coalition Elections Commissioner, Vincent Alexander, was present. Charles Corbin and Desmond Trotman were absent. Shadick related that “Mr Corbin says he fell ill and Mr. Trotman says he was threatened and he was trying to security and he is trying to get security and he can’t get,” she said.

GECOM’s rules of procedure state that in order for there to be a quorum, at least two commissioners each from both sides must be present.

Spokeswoman for GECOM, Yolanda Ward said Lowenfield did not submit his report to the GECOM Chairman because he was served with a notice of motion.

“The Notice was served on the CEO before 13:00 hrs (deadline for submission of report). The Notice restraints the CEO from ‘complying with the directions of Chairperson’ and as a consequence a report was not submitted,” Ward said.

Guyana’s constitution states that the Court of Appeal has exclusive jurisdiction to hear and determine any question as to the validity of an election of a President insofar as that question depends upon the qualification of any person for an election or the interpretation of this Constitution and any decision of that court under this paragraph shall be final.

President David Granger has publicly committed to accepting “any” and “whatever” declaration is made by the GECOM Chairman.

Lowenfield has indicated in an initial report to the Chairman that votes not affected by anomalies/irregularities and voter impersonation amount to 185,302 votes. By his calculation, the PPP would get 56,627 votes and A Partnership for National Unity+Alliance For Change (APNU+AFC) will get 125,010 and the remainder going to several small parties.

This in stark contrast to the recount that shows that of the 460,352 valid votes cast, APNU+AFC got 217,920 and the PPP 233,336. The three ‘joinder’ parties- A New and United Guyana (ANUG), Liberty and Justice Party (LJP) and The New Movement (TNM) got a total of 5,214‬ votes, but Lowenfield’s extraction of votes not affected gives the trio a total of 1,650. LJP got no votes in Regions One and Four in the CEO’s figures.

APNU+AFC Election Agent, Joseph Harmon again stressed that the Chief Elections Officer must only use untainted votes. “We are saying that the Chief Elections Officer, given his own report to the commission and the subsequent request of the Chairman, must use only the votes that had all supporting statutory documents in the ballot boxes when they were recounted,” Harmon said.

I have always firmly believed that Guyana is richly endowed with natural resources and if they were properly employed, this country could have been a extremely wealth caribbean giant.
The hydrocarbon resources which is being viewed as the new avenue for wealth beyond imagination could very easily result in nothing if this country doesn't let go of old behavior which has long resulted in poverty and hardship.
This country only have to look across is borders to Venezuela and Suriname to see what political instability could cause.
One must really wonder if national sentiment is really about collectively working towards a better future for all.
This may very well be the unfolding of another sad and violent saga in this countries history.

The Caribbean Court of Justice (CCJ) today granted an injunction restraining GECOM, it’s officers and agents from taking any steps to prejudice the fair hearing of the appeal including, but not limited to, issuing a declaration of the results of the elections held on 2 March 2020, until the CCJ issues final orders in relation to the appeal.

The country’s Chief Elections Officer, Keith Lowenfield, on Tuesday presented a report of what he considers valid votes and in so doing dumped over 115,000 votes and gave the APNU+AFC enough Parliamentary seats to form a government; the report is expected to be rejected by Justice Claudette Singh, Chair of the Guyana Elections Commission (GECOM).

Lowenfield presented his report to Justice Singh one day after the Court of Appeal ruled that valid votes must be used in determining the winner of the elections. But the Court order has been stayed for three days and is not yet in effect. Last Thursday, at just the signal of court action, Lowenfield withheld his report, but now, even though the order of the Court of Appeal has been stayed and an appeal filed with the Caribbean Court of Justice, Lowenfield has handed in his report.

In the initial report which he submitted to GECOM, Lowenfield gave as “valid” the votes from the national recount, but now he submitted a report which is completely different.

And it is unclear how Lowenfield came up with his figures, which now gives APNU+AFC 33 seats in the National Assembly, the PPP 31 seats and the three parties which joined their lists, one seat.

It's quite clear this Lowenfield character trying hard not to declare PPP/C as the winners. He removed over 100,000 votes in his report that were certified during the national recount.

The region 4 sabotage by returning officer Clairmont Mingo was the genesis of all this mess. CCJ hearing on July 1st.

He removed

40000 votes from the black party and

60000 from the PPP/c

Elections was rigged, it's clear what's going on.

He removed

40000 votes from the black party and

60000 from the PPP/c

Elections was rigged, it's clear what's going on.

The Ambassador of the United States of America, H.E. Sarah-Ann Lynch, the British High Commissioner, H.E. Greg Quinn, the Canadian High Commissioner, H.E. Lilian Chatterjee, and the Ambassador of the European Union, H.E. Fernando Ponz-Canto are concerned that 114 days after the 2 March elections the people of Guyana continue to await the declaration of an election result.

It is important in our view that every vote, cast by every voter, be reflected in that declaration, in order to ensure that the will of the people of Guyana is respected. That respect includes an election declaration of results that mirrors the order and integrity displayed by the people of Guyana, GECOM and party officials, as witnessed by domestic and international observers during the 2 March general and regional elections.

We also note that the CARICOM observer mission, referred to as “the most legitimate interlocutor” by President Granger, concluded on 15 June that “nothing we witnessed, warrants a challenge to the inescapable conclusion that the recount results are acceptable and should constitute the basis of the declaration of results of the March 2, 2020 elections.”

We believe election results are long overdue and, in that regard, we applaud the patience and peacefulness displayed by the people of Guyana. Pending the outcome of the appeal to the CCJ, we trust GECOM to meet its constitutional duty to issue a Declaration on the basis of the results of the Recount as confirmed by CARICOM, to ensure the democratic choice of the people is fulfilled.

Trinidad under PNM is following the same pattern as the EBC is under their control
