Breaking News: Privy Council overturns local courts decision on MALCOLM JONES and Petrotrin. Finds Faris WRONG.
STATEMENT FROM CLAIMANT
Early this morning the Law Lords at the Privy Council delivered a landmark victory in my favor against Petrotrin. This was the first Freedom of Information case to reach the Privy Council and the victory is especially important as it had previously been defeated in both the High Court and Court of Appeal. By reversing both local courts, the Privy Council has thereby reaffirmed the strong rights which average citizens such as myself possess under the FOIA in accessing confidential information. For this I must congratulate the team of attorneys led by Mr. Richard Clayton QC and Mr. Anand Ramlogan SC on their expertise that led to this triumph.
The sequence of events whereby Mr. Vincent Nelson QC and Mr. Russel Martineau SC provided strong and detailed legal opinions for the institution of legal proceedings against Petrotrin's Executive President Malcolm Jones for negligence and breach of statutory duty is in stark contrast to Mr. Nelson's sudden later advice that led to the claim being abandoned by the present PNM administration. Nelson's flip-flop was criticized by the Law Lords at the Privy Council during the course of the hearing because its timing and content gave rise to much suspicion. Communications Minister Maxie Cuffie was singled out for mention in the judgement because he was apparently able to predict this strange turn of events when announced at a press conference three days before Nelson gave his advice that the claim against Malcolm Jones was likely to be withdrawn of dismissed. It begs the question, how did Maxie Cuffie know this was going to happen in advance?
To make matters worse, the claim against Jones was abandoned without consulting Mr, Russel Martineau SC who had also given a strong legal opinion to then AG Anand Ramlogan, recommending that the case be pursued. Why was the PNM government so anxious and quick to rely upon Nelson's two paragraph advice to withdraw a billion dollar claim on Jones without having the benefit of a second opinion from the other Senior Counsel?
This judgement now raises concerns regarding the credibility of Mr. Vincent Nelson QC, and as such the following questions must now be answered:
Was Mr. Nelson conspiring with the PNM government to facilitate a predetermined political agenda to abandon the case?
Was Mr. Nelson's legal advice a mere smokescreen that was designed to provide cover for a political fait accompli?
Why did Mr. Nelson even bother to comment on the merits of the case when he was simply asked to advise on the limited issue of whether the arbitration witness statements could be disclosed in the High Court case against Mr. Jones?
Was Malcolm Jones' appointment to Cabinet Standing Committee on Energy whilst the case was pending an indication that the PNM government had already decided to ditch the case?
How much was Vincent Nelson QC paid for his advice that led to the abandonment to the case against Mr. Malcolm Jones?
If Mr. Nelson was part of a political conspiracy designed to provided slim legal justification to abandon the very case he had strongly recommended be pursued when the UNC was in government, then recent events regarding his evidence against Mr. Anand Ramlogan SC and Gerald Ramdeen must be carefully examined to determine whether he is once again singing for his supper. After all, Mr. Nelson initially advised then Attorney General Anand Ramlogan to pursue the case, before suddenly changing his mind when the PNM administration came into office.
The current Attorney General, Mr. Al Rawi must also come clean on this matter and explain why they have been so secretive with the witness statements which Mr. Nelson used when forming his opinion. I have been fighting for public justice to secure disclosure of those witness statements to determine whether a political conspiracy involving powerful figures in the PNM government and legal advisors led to the toppling of a billion dollar case that could have saved the jobs of over 5,000 Petrotrin employees.
I have nothing personal to gain in this journey for public justice. This is therefore a victory for the citizens of this country who have a right to know the truth about the political machinations that occur behind closed doors to their detriment. Make no mistake about it, the failed Gas-to-liquids project that cost Petrotrin and our taxpayers billions of dollars is directly responsible for its present closure and the consequent economic hardship. Every Petrotrin employee has suffered a grave injustice and we must demand answers and stop playing games!
