POLICE Commissioner Gary Griffith has taken legal action against a former cricketer for statements on a news website questioning the brief inclusion of the commissioner’s son on Trinidad and Tobago’s national football team.
Griffith’s attorneys Larry Lalla, Vashisht Seepersad and Taruna Mangroo, of the law firm Atticus Finch, filed the defamation claim against Deonarine Deyal, one of the TT Cricket Board’s under-19 selectors. Deyal was served with the claim on June 9.A judge has yet to be assigned to the matter.
Griffith’s claim accuses Deyal of making a highly defamatory post under a news article on the Wired868 Facebook page about the selection of his son Gary Griffith III. The post was made on January 27.

Police Commissioner Gary Griffith has warned that people making comments on social media deemed to be threats or incitement to violence, can be charged . He made the statement in a enws release today. The following is a statement by the Police Service.
Commissioner of Police, Gary Griffith, notes with concern the recent upsurge in the belief that persons can make veiled or actual threats and incite others to violence, particularly through an expression of themselves on social media or otherwise. The CoP has also noted reports from public officials, particularly from both sides of the Parliamentary floor of such threatening conduct.
The CoP added, “Whilst citizens have a constitutional right to freedom of expression and speech, such rights cannot be exercised in an irresponsible manner, which infringe on the rights of others, including public officials.” Such conduct, according to the CoP, which threatens, incites, and/or encourages others to act in a manner that can lead to violence, will not be tolerated and such persons will be made to face the full brunt of the law. Such persons will be visited by the TTPS and action will be taken where necessary.
The CoP reminds persons that the above-described threats can constitute an offence of harassment as set out at Section 30A and 30B of the Offences Against the Person Act, Chap 11:08. Section 30A of the Offences Against the Person Act states, “(2) A person who pursues a course of conduct which amounts to harassment of another and which he knows or ought reasonably to know amounts to harassment of the other, is guilty of an offence and is liable on summary conviction to a fine of two thousand dollars and to imprisonment for six months”.
Section 30B of the Offences Against the Person Act “(1) A person who is accused of conduct which would constitute an offence under section 30A and which causes the other person to fear that violence will be used against him, and the person whose course of conduct is in question knows or ought to know that his conduct will cause the other person so to fear, commits an offence and is liable on conviction on indictment to a fine of ten thousand dollars and to imprisonment for five years or, on summary conviction, to a fine of five thousand dollars and to imprisonment for six months”.
Members of the public are asked to like and follow the TTPS via our Facebook and Twitter pages for the latest news and information on matters of interest to the general public. 2 Persons who encourage persons to engage in threatening conduct are also reminded that they may be held liable under the Accessories and Abettors Act, Chap 10:02 which states: “Any person who aids, abets, counsels or procures the commission of any indictable offence may be indicted, tried and punished as a principal offender”. Commissioner Griffith advises that the Cyber Crime Unit will be monitoring social media for persons intent on committing such offences and they will be detained and the requisite charges laid where applicable.

No Bail for Man Charged with Stealing Police Vehicle
An Avocat man was denied bail when he appeared before a Port of Spain Magistrate charged with stealing a police vehicle and impersonating a police officer.
SATESH RAMSAMOOJ, of St. John’s Road, was also charged with forgery of a document, uttering a forged document, and obtaining goods by false pretence, when he appeared virtually before Magistrate Maureen Gafoor, at the Port-of-Spain Magistrates’ Court.
He was denied bail and the matter was adjourned to July 26th 2021.
On Thursday 24th June, 2021, officers of the Tableland Police Station stopped a marked police vehicle which was escorting two trucks along the Naparima Mayaro Road in Tableland. The driver of the police vehicle told the officers his name was PC Ramroop. Upon being asked to produce his police identification card, he sped off in the vehicle. The car was subsequently intercepted and the driver arrested.
Officers of the Professional Standards Bureau (PSB) were contacted and investigations revealed that the suspect had lied about his identity and the police vehicle had been stolen. Further investigations revealed that the suspect was not a police officer and had no permission to keep and drive a marked police vehicle. It was also found that the vehicle had a false number plate.
Ramsamooj was charged with the offences by Cpl (Ag.) Smith of PSB, on June 29th 2021, following advice received by Director of Public Prosecutions (DPP), Roger Gaspard SC on that same date.

Persons don't know how to express themselves properly which can lead to such legal issues.
For example, the cricket guy that Gary sent a pre action protocol letter to. I didn't see the actual comment but based on the contents of the letter it stated the guy made a statement that Gary ||| got into the national team because Gary used his power and by giving Fenwick a FUL.
What he should have said was giving the limited football experience of Gary ||| at even secondary school level and no experience at professional or semi professional level it leads me to question whether he was selected based on merit or whether external influence played a part. As well given the normal lengthy period citizens face in obtaining a FUL, it makes me question how Fenwick was able to obtain one and whether it was related to Gary |||'s selection.

Irwin Hackshaw, as acting CoP, tried bullying Express but it didn't work out. Express seems to have expert legal advice provided to it and possibly proactive in seeking legal advice about articles prior to publishing.
