CANADIAN blogger and YouTuber Chris Must was arrested by police officers of the Special Investigations Unit(SIU) on Tuesday morning and is facing possible charges under the Anti-Gang Act and Immigration Act.
Senior law enforcement sources told The Express that just after 6 a.m., Must was taken into custody by officers at a Flag Staff, Long Circular home and questioned regarding several YouTube videos featuring interviews with different gang members from Tunapuna, Morvant, La Horquetta, Belmont, and Sea Lots.
Must, The Express understands had visited the Canadian Embassy on Monday seeking assistance and was told to contact attorney Criston Williams for advice.
"We had to pick him up based on these videos brandishing firearms under the Anti-Gang Act," a senior intelligence source said.
Referring to several YouTube videos posted by Must over the last few weeks about Trinidadian gangs the senior source explained, "In this context what he did wrong was that he was filming different gangs who were sending subliminal threats to other gangs in those videos. He was technically promoting the gang and their ability to show their firepower to the other side. He provided a platform to do that and allowed this material to be distributed without even putting a disclaimer on the material and be responsible," explained the senior intelligence source.
Under the Anti-Gang Act Section 8 states: A person who knowingly— (a) counsels; (b) gives instruction or guidance to; (c) finances in any manner; or (d) otherwise provides support to, Counselling a gang, a gang leader, gang member or gang in furtherance of its participation in, involvement in or commission of a gang-related activity commits an offence and is liable on conviction on indictment to imprisonment for twenty-five years."
Another senior police source indicated that the SIU "had downloaded and analysed" these videos over the last few weeks before deciding to arrest Must under the Anti-Gang and Immigration Act.
"Persons are brandishing firearms and claiming to be gang members in these videos and are saying they will kill this one and that one," said the senior source.
They identified that under Section 5.1 (d) a person who professes to be a gang leader or a gang member in order to— (i) gain a benefit for himself or another person; (ii) intimidate other persons; or (iii) promote a gang, commits an offence.
According to senior police sources, they also discovered that men claiming to be members of gangs who were State witnesses under protective custody in criminal cases appeared in some of the recordings that Chris Must, also known as Chris Must List, streamed.
"We know that some of these men had been in protective custody and had given evidence in matters so it was shocking to see them in these videos saying they belong to this gang or the next," said the police source.
Intelligence sources confirmed that Must's interview with officers of the SIU will continue today and are expected at some point to confer with the DPP Roger Gaspard on the possible charges. Must was questioned for several hours on Tuesday.
Must police indicated is also expected to be charged with breach of offences under the Immigration Act. They indicated that Must entered the country as a tourist for vacation rather than for work activities.
One of Must's attorneys CJ Williams was contacted last night and he told the Trinidad Express, "When we went to the police station they told us he was not under arrest but he could not leave," explained Williams.
Williams said a police officer who spoke to him said they could not guarantee Must's release today.
