btw OP, don't expect anything but ole talk in this thread eh. Law is a serious thing, and you can't be getting your legal advice from an internet forum. While there may be good advice here and there, you can't know if it's true or will mean anything in a courtroom as applicable to your specific circumstances.

You need to consult a lawyer in real.

Show me a case in this country where any prenup was consider legally binding, ever, and I'll give you my 73 bedroom beachfront townhouse on Mars for free.

the long and short as it is 3, you need to get agreement from the third party to be able to move forward with anything
usually in a case of husband and wife who cannot agree, the judge will compel to do valuation and sell house and split the cash
in this case it is unlikely they could force the third hand just so, but will be interesting to see

Usually in a case where there is joint ownership, you either sell your share or buy out the rest of shares.

yes, but this case ain't that straight forward. remember, she entitled to 1/3 of the whole, so it may not have been subdivided yet among the owners, so in a sense her portion still mixed up with everybody else own.
Best case scenario for him, they'd have to subdivide the properrty & then value her portion & she pay him half the value (which she may not want to do)

assuming third party agree to that
many times the other parties live on the said premises and have wife and chirren who will not agree because they have to find a new place which will be difficult to start with a 1/3 portion of cash
assuming place is attractable to be sold

relative of mine had to do that during a divorce
the ex husband did not want to sell the place even though there was a court order.
he would make sure to be there when prospective buyers showed up to harrass them.
