Two public servants — a foreign affairs officer, and the other, a State lands officer — yesterday won their appeals when the Appeals Court ruled they were “unfairly treated” by Prime Minister Patrick Manning.
Public Servant Feroza Ramjohn, was not allowed to take up a foreign diplomatic post in London, because of a report which stated she may have been “a security risk.”
Ramjohn who had been a career public servant with the Foreign Affairs Ministry for 38 years had served in the Permanent Mission to the United Nations, and the New York Consulate.
In the wake of drug trafficking allegations involving a diplomatic pouch between the London High Commission and the Ministry, certain persons were recalled from the London Mission to face criminal charges in Trinidad. On May 27, 2004, Ramjohn was summoned to a meeting and told she should make immediate plans to leave for London to assume a position in the London Mission. A letter was given confirming her appointment. As a result, Ramjohn promptly disposed of her belongings, served notice on her landlord, and completed a medical and psychological assessment.
However, as she was about to leave for London, she was informed that her transfer to London had been quashed by Prime Minister Manning. No reasons were given. It subsequently emerged that Ramjohn was being blamed for some 200 missing passports in circumstances which the Court of Appeal described yesterday as “purely circumstantial.”
Ramjohn was never before told of the allegations although being twice promoted since the incident in June, 2001.
Yesterday, the Appeal Court ruled that the Prime Minister treated Ramjohn “unfairly by blocking her transfer to London, without informing her that she was a considered threat to National Security. Ramjohn was never given an opportunity to clear her name, although having “an unblemished record of performance for over 35 years.”
The Appeal Court found that because the PM had a constitutional power to veto Ramjohn’s transfer, it did not give him an absolute right.
The veto it found, must be exercised fairly in accordance with the principles of natural justice. The court further declared that Ramjohn was a victim of “unfair treatment” by the Prime Minister. The other public servant, Ganga Persad-Kisson, had his promotion to Commissioner of State Lands vetoed by Prime Minister Manning, deeming he was “unfairly treated. Persad-Kisson had applied for the vacant position in March, 2001. He was interviewed by the Public Service Commission, and had topped the interviews. He was also the most qualified and senior candidate for the job.However, the Prime Minister vetoed Persad-Kisson’s position without giving reasons. The person second in line got the job.Yesterday, the Appeal Court which comprised Chief Justice Ivor Archie, and Justices Margot Warner and Allan Mendonca, found Persad-Kisson was treated unfairly when he was bypassed for promotion, and that the PM was wrong to veto his promotion without telling him why. Ramjohn, the foreign affairs officer was represented by attorneys Dr Fenton Ramsahoye SC, and Anand Ramlogan.
Following the judgment Ramlogan, speaking to the media on the steps of the Hall of Justice in Port-of-Spain, called for the “removal of the power of veto.”
