FLORIST Vijay Nanan, who tried to sell $5,000 worth of flowers for Father's Day without a licence, appeared before the court facing three charges yesterday.
But San Fernando Magistrate Lisa Ramsumair-Hinds asked why Nanan was the only one before her court facing such charges when there would have been others who took the risk of offering items for sale in a bid to make extra money over the Father's Day weekend.
Nanan was charged with pitching a stall, obstructing the passageway and offering the items for sale without a licence from the San Fernando City Corporation.
He was seen along Gulf View Link Road around 5 p.m. last Friday standing next to a makeshift stall saying, "Flowers, flowers, fresh flowers for sale," police prosecutor Ramdath Phillip said.
Motorists had to divert their course to avoid contact with the defendant.
Before the Sixth Court yesterday, four buckets containing carnations, roses and orchids were displayed before Ramsumair-Hinds.
She said Nanan took a "calculated risk" by pitching the stall to sell the flowers.
The magistrate said while she did not want to cast aspersions on the character of the officers who were within their rights to lay the charges, "Many other stalls would have been unlawfully pitched and obstructed the passageway for Father's Day and also for Mother's Day and Valentine's Day.
"No other charges were laid for unlawfully pitching a stall from Friday, Saturday and Sunday along the whole of the San Fernando, Gulf View Link Road ...I am troubled. There has to be an everyday principle of fairness."
She said the law should be used equitably.
Ramsumair-Hinds reprimanded and discharged Nanan on all three charges.
No note of the charges will be recorded against his name.
The flowers were ordered returned to him.
Nanan said he will be able to sell them for $7,000.

Dem fellas who does be selling in d middle ah d highway walking up and down is a real menace...sometimes in d evening is like "dexing" on d highway when yuh want to switch lanes... :|

I think the main issue was "pitching a stall, obstructing the passageway", not so much selling flowers. You need a license to set up stall in the city. IMHO the judge was very FAIR with the ruling...!!! That POPO was probably trying to meet quotas.

Don't think there is a license to sell in the middle of the road, but then again police does pass them without saying anything. They probably have insurance to in case they hit someone's car.

I am no longer surprised by such things, don't even raise an eyebrow. This sorta thing has become so common place in Trinidad and Tobago that I myself have become complacent. Sure he didn't have a license, but a man gets arrested for doing something (completely legitimate) to make an honest living, yet the ones who commit crimes ranging from misdemeanors to the most heinous are allowed to roam free.

Some officers just don't know how to make a judgement call. Yes they have laws to enforce, but that vendor was not hurting anyone. How can you single out one man just so? Shouldn't the punishment fit the crime? And IMHO that was not even a crime. Throw a man in jail for that! At most he only deserved a stern warning and request that he removed his stand (and if he did not know about the license, educate him, give him the info required so that he now knows the correct procedure for the future).

I know that there are some officers out there that would see things like these and turn a blind eye. Not because they are lazy in carrying out their duties, but simply because they can very well see that no one is being hurt, harmed or disadvantaged in any way and that an individual is just trying to make a living. On the other end of things when these same officers hear or are alerted to gun fire, they are the first on the scene. We need more officers like these. Those with both a sense of duty AND heart!!!
