FLORIST Vijay Nanan, who tried to sell $5,000 worth of flowers for Father's Day without a licence, appeared before the court facing three charges yesterday.
But San Fernando Magistrate Lisa Ramsumair-Hinds asked why Nanan was the only one before her court facing such charges when there would have been others who took the risk of offering items for sale in a bid to make extra money over the Father's Day weekend.
Nanan was charged with pitching a stall, obstructing the passageway and offering the items for sale without a licence from the San Fernando City Corporation.
He was seen along Gulf View Link Road around 5 p.m. last Friday standing next to a makeshift stall saying, "Flowers, flowers, fresh flowers for sale," police prosecutor Ramdath Phillip said.
Motorists had to divert their course to avoid contact with the defendant.
Before the Sixth Court yesterday, four buckets containing carnations, roses and orchids were displayed before Ramsumair-Hinds.
She said Nanan took a "calculated risk" by pitching the stall to sell the flowers.
The magistrate said while she did not want to cast aspersions on the character of the officers who were within their rights to lay the charges, "Many other stalls would have been unlawfully pitched and obstructed the passageway for Father's Day and also for Mother's Day and Valentine's Day.
"No other charges were laid for unlawfully pitching a stall from Friday, Saturday and Sunday along the whole of the San Fernando, Gulf View Link Road ...I am troubled. There has to be an everyday principle of fairness."
She said the law should be used equitably.
Ramsumair-Hinds reprimanded and discharged Nanan on all three charges.
No note of the charges will be recorded against his name.
The flowers were ordered returned to him.
Nanan said he will be able to sell them for $7,000.
