As before, the issue isn't reckless use of a motor vehicle. It is about whether DUI was the issue.rspann wrote:this isn’t a free pass to drive like a madman (or woman) in the mall parking lot. That word “except” is followed by some traffic violations that officers can enforce on private property. These include impaired driving, reckless driving, negligent driving, vehicular homicide, vehicular assault and hit-and-run traffic collisions. I think we can agree that even on private property those kinds of actions deserve to be investigated and the laws prohibiting them enforced.
To get back to the original question, failing to stop for a stop sign in a parking lot wouldn’t get a driver a traffic infraction, but if in the process of not stopping the driver showed complete disregard for the safety of others, the driver could get arrested.
There are nearly 11 million arrests in the US every year. DWI/DUI are typically interchangeable.rspann wrote:What is impaired driving in the paragraph I quoted?

So it would have been responsible to let him go free with a police tazer and the fact that he was threatening the police themselves with it???
I think you all are quite biased!
They did what was necessary..........

There was a case where a guy was sleeping in his car drunk in a parking lot. He won his case as he was not on a public road .

In most US states it is also legal to drive in a private lot with no driver's permit or vehicle registration -- that calls into question the applicability or any law regarding driving under the influence. Directing a driver suspected of DUI to move his car has typically resulted in charges being dropped due to entrapment.
The lot is open to the public which brings applicability to another set of laws regarding public behavior and display. Public intoxication typically has a much higher blood alcohol level.

Qualified immunity protects the reasonable official from legal peril while performing their duties.
Relevant precedent:
Malley v. Briggs
In Malley v. Briggs, 457 U.S. 335 (1986), the Supreme Court examined immunity for police officers with regard to acting on the basis of a faulty warrant. The Court held that qualified immunity does not apply to a police officer when the office wrongfully arrests someone on the basis of a warrant, if the officer who could not reasonably believe that there was probable cause for the warrant. Reasonability is determined by the action that an objectively reasonable officer would take.

And so what if he gets shoot in the back? What is your point?
Wife and 3 kids? AND he wasted AF behind the wheel? Such a great father figure, such responsibility. What kind of example is that. Save the family card bullsheit.
Now what if this wife or kids you expect ppl to show sympathy over had a medical emergency? You really think this “family man” could have responded appropriately? The dead beat dad was struggling to find his license for heavens.
But i understand where ur coming from, its a BLM mentality though eh, always praising/defending criminals.
Think it over again Zoomy, i want you to agree with me.
