The confirmation came in the aftermath of a video published by drone pilot Shiyé Bidziil on the news website Indian Country Today titled, “Drone Footage of Dakota Access Pipeline Approaching Missouri River.” Published November 2, this video offers an airborne view of pipeline construction — coupled with heavily guarded concrete fortresses around key construction locales — in close proximity to the Missouri River.

“The Army will not authorize constructing the Dakota Access pipeline on Corps land bordering or under Lake Oahe until it can determine whether it will need to reconsider any of its previous decisions regarding the Lake Oahe site under the National Environmental Policy Act (NEPA) or other federal laws,” reads the initial September 9 statement disseminated by the U.S. Department of Justice, U.S. Department of Interior, and Army Corps.

“Therefore, construction of the pipeline on Army Corps land bordering or under Lake Oahe will not go forward at this time. In the interim, we request that the pipeline company voluntarily pause all construction activity within 20 miles east or west of Lake Oahe.”

After showing the video to Curry Graham, Director of Public Affairs for the Army Corps, Graham confirmed to DeSmog that Energy Transfer Partners has proceeded with construction inside of the administration's requested zone. Graham also said construction has halted just short of the federal property bordering Lake Oahe.

“After the DC courts ruled in favor of the federal government, federal agencies asked the Dakota Access pipeline company to voluntarily pause all construction activity within 20 miles east or west of Lake Oahe,” Graham told DeSmog. “The key word is 'voluntary,' and the company chose to proceed with construction. As to why they did this, you will have to contact Energy Transfer Partners to ask that question.”

Which DeSmog did. Energy Transfer Partners spokesperson Vicki Granado responded, “We are constructing along the four-state route in accordance with applicable laws, and in areas where we have the necessary local, state, and federal permits and approvals,” Granado told DeSmog.

The Department of Justice and Department of Interior did not respond to a request for comment.

On October 31, President Barack Obama said the Army Corps is considering a reroute of the Dakota Access pipeline in this area and will let federal agency regulatory processes “play out” in the next several weeks. It remains unclear how the pipeline could be rerouted if construction is already occurring up to the Missouri River and Lake Oahe.
No-Fly Zone

Drone videographer Bidziil secured the footage after the U.S. Federal Aviation Administration (FAA) lifted the Temporary Flight Restriction (TFR), which was supposed to be in place from October 26 through November 5, but ended after coming under public criticism.

The no-fly zone was initially put in place because protestors at the Standing Rock encampment in North Dakota had allegedly fired arrows at a law enforcement helicopter and used their own drone to scan the area which was shot down by law enforcement. Donnell Hushka, the Public Information Officer for Morton County, North Dakota, did not respond to a request for comment about whether the Morton County Sheriff's Department or another law enforcement agency had issued an incident report pertaining to the alleged incident involving arrows.

In 2014, another restricted flight zone was also put in place in Ferguson, Missouri, in the wake of protests erupting after the shooting of Michael Brown by law enforcement. The Associated Press obtained audio documentation demonstrating that the FAA had issued the restriction, in that case, in the attempt to shoe away airborne media.

Lee Rowland, an attorney for the American Civil Liberties Union's (ACLU) Speech, Privacy & Technology Project, pointed to the Ferguson example as a reason to be wary of initial explanations for the necessity of such temporary no-fly zones.

“Because the FAA now has a history of being caught on tape implementing a no-fly zone for the specific purpose of censoring media flights, I'm not sure they're entitled to an assumption of good faith that this no-fly zone had been put in place for valid reasons,” Rowland told DeSmog.
“Everyone Feels Broken”

Explaining how he felt about the footage his drone captured, Bidziil expressed a sense of consternation.

“Everybody’s mad. Everyone feels hurt. Everyone feels broken, but we can’t let them break us,” he told Indian Country Today. “We just have to stand here and do what we can.”

Greenpeace USA spokesperson Lilian Molina also responded to the news, pointing to Energy Transfer Partner's recent sordid history of environmental regulatory violations.

“To think Energy Transfer Partners would respect a voluntary request to be decent, even one by the President of the United States, was wishful thinking. If the Obama administration really wants to pause construction, as the President suggested he does, it needs to continue to suspend ETP’s permits to build under the Missouri River,” said Molina.

“This debacle also shows the need to make the Army Corps of Engineers’ permitting process much more transparent, with a full environmental review and thorough, participatory tribal consultation.”

The Obama administration currently is conducting formal, government-to-government consultations with Native American tribes across the U.S. in order to obtain tribal input on how federal decisions are made about major infrastructure projects. The final consultation is set for November 21 via teleconference, with four more sessions slated between now and then, including the November 17 consultation in Rapid City, a few hours drive from Standing Rock.



Probably I was being loose with my language, when I said that they mouth zipped.
Obama did actually suggested to stop the pipeline construction.

My issues were that he also said that both sides should refrain from violence. But the police officers continue to not just be violent, but violate human rights.
There is supposed to be representatives from the department of justice there to ensure the pipeline isn't still being constructed, and both sides are being fair. There isn't any there.
Even though there isn't much legacy media coverage of the standoff, well more like a legacy media blackout, there is a lot of amature and progressive sources making the stories available. So Obama would still be aware of the aggression of the olive officers against the people, and even the stories of the false charges being made on the people.

Yet he continues to dismiss the actions of the police, dismisses the experiences of the protectors, and doesn't issue resources to ensure this suggestions are upkept.

And he does say he wants it to play out...

The drone video already shows that the work is not halted, the rate at which the work is going on, it was way further ahead from where Obama had said it should remain.

So, I will give u right, Obama wasn't mum.
But what ever he said, was impotent.




Imagine, kublalsingh was able to get Jamal to halt the Pt. Fortain highway project for consultation with kamla.

Fleckin kamla was more respectful, diplomatic, humane and effective than your Nobel peace prize winner, corporate puppet Obama.

A lot more professors also predicted a UNC win and a Remain in EU win for Britain.

Now Mike Pence thinks he can win Pennsylvania which is a Democrat state Bill O Reilly thinks its a long shot but Pence believes other wise. I won't lie if Trump wins that state its game over it will be like when PNM won Tableland last year a UNC stronghold.

These sheit heads were so off, talking about a PNM loss and the PNM not only won by a landslide but they managed to pull off the popular vote AND take a UNC stronghold at the same time just imagine that? and mind you the voters were quiet eh, when the silent majority voted that was the sneak attack of a lifetime. Brexit came shortly after and at that point I realize how useless these polls are.

I was watching a Trump rally and Rightside Broadcasting covering the stream had reported that people were messing with their equipment the guy mentioned this a couple weeks now but today he saw a camera guy from MSNBC who purposely knocked over his camera TWICE.

And Rightside Broacasting is the only camera crew there who turn their cameras to show the crowd. So it just goes to show you how dangerous it is to show your support for Trump in public. If its not MSNBC camera crew trying to damage your equipment its Hillary paying her SJW welfare sucking parasites $1500 to punch Trump supporters in the face or scratch up their vehicle break their windscreen etc. I too would be quiet in fear of my own life and just vote quiet. Hillary also has a troll camp of bloggers like Kamla aswell abusing people online.

That sure was a journey I have never seen anything like this in my life or even a politician capable of calling out the establishment and the new world order like this this man has been doing up to 6 rally a day each a different state and different location often right in the airport the amount of people who show up for Trump is insane, Hillary does not even come close to this movement. This will be down in the history books, here is to Trump winning by a landslide and the death of the establishment who think the people should serve them.

Bet your bottom dollar she will do it, she has tried to ban video games in the past and claimed that video games causes violence she is one of the old farts who are dangerous to society. A lot of people do not realize there is a reason the top 1% wants her elected so bad and are spending a fortune to get her in office. But I am confident there are enough intelligent people in this world to see this. Believe me it won't stop there either if you think the middle east is in turmoil now wait till she faces down Putin over Syria in a bloody land war which will turn nuclear.

WOW there is actually one more rally, at 1 AM in the morning? this man doh sleep. Holy sheit this is the end I actually watched almost all of these rallies live.

I suspect that there is a somewhat possibility that I may not be on this earth much longer, therefore my dying wish is to see Trump win so I can witness the massively epic beatup from the social justice warriors. To see the dishonest people at CNN physically explode, this is my dying wish.

Yes Hillary's 3K viewers is pathetic, they can't hide this from us thanks to the internet we can actually see where the real support is.

Trump's 70k viewers for a political rally at 1:48 AM in the morning over 18,000 people are at that rally right now. These people should be sleeping to get ready for work in the morning but look where they are.

You will NEVER see this in any Hillary rally even Obama didn't have this kind of movement. This is why I said many times I do not believe a single one of those polls there has never been support like this before.

Trump is the only non politically correct politician who had the balls to stand up to the 1% who control everything.

My dying wish make Trump win so we can see the SJW beatup.

^ Ent, people who live in the real world couldn't give half a sheit about what a millionaire celebrity has to say. Beyonce, JayZ and Gaga can't put food on the table for a man to feed his family. No right thinking person is going to listen to what a paid celebrity living in a bubble has to say. At most they will show up for the live singing performance but come election day they won't even bother to get up to vote.

The same JayZ who was complaining some years ago in the depression crying about how he cannot afford gold chains and diamonds anymore cause nobody cares about his music anymore and people actually thought he was crying about something useful. But this jackass coming to tell people about voting for Hillary?

The establishment is dying on its ass and will be a glorious day when it finally kicks the bucket.
