(TRINIDAD GUARDIAN) Mem­ber of Par­lia­ment for Laven­tille East/Mor­vant Adri­an Leonce says his wife who suf­fered se­ri­ous in­juries to her face af­ter falling at home is re­cov­er­ing af­ter three “ex­ten­sive surg­eries.”

Two weeks ago, Leonce post­ed a state­ment on so­cial me­dia ask­ing for prayers for his wife who was in a “ter­ri­ble ac­ci­dent”.

There have been very lit­tle up­dates on her con­di­tion since then ex­cept for calls from staff at Mt Hope Med­ical Com­plex that Leonce’s wife did not show any in­juries as­so­ci­at­ed with a car ac­ci­dent as it was on­ly her face that was dam­aged.

In fact, the in­juries were so se­vere that staff at Mt Hope said she re­ceived three fa­cial re­con­struc­tion surg­eries.

In an in­ter­view on Sat­ur­day and What­sApp ex­changes over the week­end, Leonce said it was not the first time he heard ru­mours that he was vi­o­lent to­ward his wife. He de­scribed the per­sis­tent ru­mours as “mis­chief”.

“I have heard that talk about do­mes­tic vi­o­lence,” Leonce said.

“It is un­for­tu­nate that some­one would say things like that at a time when my wife is at home re­cov­er­ing from her ex­ten­sive surg­eries,” he said.

Leonce con­firmed that there was no po­lice re­port made of the ac­ci­dent be­cause it was not ve­hic­u­lar. “She fell at home,” he said.

He said he was not at home when his wife fell but he got a call from his daugh­ter and took his wife to the South­ern Med­ical Cen­tre but was di­rect­ed to Mount Hope be­cause of the ex­tent of her in­juries.

“It will be sad if this fab­ri­ca­tion is per­pet­u­at­ed and start to af­fect my chil­dren who are al­ready trau­ma­tised af­ter see­ing their moth­er in a near death-state,” Leonce said via text.

“It is un­for­tu­nate that any­body would take an ac­ci­dent that al­most cost my wife her life and con­vert it in­to some­thing that is not on­ly un­truth­ful but dan­ger­ous,” he said.

He said there was no truth to the as­ser­tion that he was per­son­al­ly in­volved in his wife’s in­juries.

“Karen Lee will nev­er be com­plete­ly healed. We are hap­py to have her home af­ter three-long surg­eries. Karen-Lee is go­ing to be away from work for a long time,” he said. Leonce said it was a “tremen­dous chal­lenge” for him to keep things to­geth­er since his wife’s fall.

The honourable Dr Keith Rowley, please put new cards in the pack before reshuffling. Member of Parliament for Laventille East Adrian Leonce was successful in the 2015 general election when he presented himself as a candidate, capturing a total of 13,662 votes. Being a young person, it was refreshing to see new blood being injected into the political arena.

However, it has been approximately two years, seven months with many mishaps involving current ministers, but to date the card of Member of Parliament Laventille East constituency hasn’t been played.

LEONCE CONSIDERING LEGAL ACTION AGAINST NEWSPAPER

Laventille East/Morvant MP Adrian Leonce is considering legal action against the Guardian newspaper for alleged defamation of character.

Leonce has issued a media release in which he contends a recent Guardian newspaper article inferred he was violent and abusive toward his wife.

The MP says his attorneys will move to seek a public apology from the newspaper, and an order to cease and desist any defamation of his character.

Leonce's wife, Karen-Lee Bethelmy Leonce, had been warded in hospital. He told the Guardian she had surgery for injuries sustained during a fall.

He said while being interviewed for the article, the Guardian journalist raised questions about abuse. Leonce says he categorically denied the allegation.

Leonce says the article, published on October 8th, painted an eerie and negative perception that misrepresented what happened to his wife.

He claims the article has also encouraged defamatory comments online.

Mem­ber of Par­lia­ment for Laven­tille East/Mor­vant Adri­an Leonce yes­ter­day is­sued an ad­ver­tise­ment con­tain­ing a mis­lead­ing and in­ac­cu­rate ac­count of le­gal pro­ceed­ings brought by the MP and his wife against Guardian Me­dia Lim­it­ed (Guardian Me­dia) and one of its re­porters.

The ad­ver­tise­ment, dat­ed No­vem­ber 3, 2018, was pub­lished on­line on a Peo­ple’s Na­tion­al Move­ment so­cial me­dia page.

Leonce was rep­re­sent­ed by, among oth­ers, at­tor­ney Farai Ma­sai­sai, se­nior le­gal part­ner at Hove and As­so­ciates.

On Fri­day, a No­tice of Ap­pli­ca­tion filed on Oc­to­ber 31, 2018, on be­half of Leonce and his wife Karen Bethelmy-Leonce came up for hear­ing be­fore Jus­tice James Aboud.

The ap­pli­ca­tion sought, among oth­er things, an in­ter­im in­junc­tion against the re­pub­li­ca­tion of an ar­ti­cle pub­lished by this news­pa­per on Oc­to­ber 8, 2018, con­cern­ing Leonce and his wife.

This news­pa­per wish­es to cor­rect the record and make it clear that the ad­ver­tise­ment con­tains as­ser­tions of fact which are demon­stra­bly false, er­ro­neous and which are sim­ply not true.

The pub­lic record of the pro­ceed­ings will show that there was no in­junc­tion (in­ter­im or oth­er­wise) grant­ed by Jus­tice James Aboud on No­vem­ber 2, 2018, against GML or any of its ser­vants and/or agents.

At the hear­ing on Fri­day, Guardian Me­dia gave a lim­it­ed un­der­tak­ing, among oth­er things, to have the ar­ti­cle com­plained of re­moved from its on­line edi­tion pend­ing the hear­ing and de­ter­mi­na­tion of the sub­stan­tive mat­ter.

At­tor­neys for Guardian Me­dia to­day wrote to one of the at­tor­neys rep­re­sent­ing Leonce and took is­sue with the ad­ver­tise­ment. Guardian Me­dia al­so re­fused to pub­lish the ad­ver­tise­ment be­cause of the bla­tant in­ac­cu­ra­cies.

Guardian Me­dia at­tor­ney An­dre Rud­der al­so sug­gest­ed that Leonce and his coun­sel (Ma­sai­sai) would do best not to have the ad­ver­tise­ment pub­lished in any of the oth­er lo­cal news­pa­pers.

In the ad­ver­tise­ment, it is wrong­ful­ly as­sert­ed and claimed that Leonce was grant­ed an in­ter­im in­junc­tion against the me­dia house.

"For starters, there was no in­ter­im in­junc­tion as sug­gest­ed by the cap­tion. Sec­ond­ly, the ar­ti­cle is not defam­a­to­ry nor was there any ac­cep­tance (or find­ing by the Judge in whose province this lies) that the ar­ti­cle was defam­a­to­ry as as­sert­ed in the sec­ond para­graph of the re­lease. Third­ly, your clients as you well knew did not get un­der­tak­ings in terms of the in­ter­im in­junc­tive re­lief sought as as­sert­ed in the third para­graph of the re­lease," Rud­der said in an email re­sponse.

"Your clients (the First Claimant in par­tic­u­lar) have clear­ly not tak­en to heart the sug­ges­tion of the Ho­n­ourable Judge that the un­der­tak­ings could and should bring a con­clu­sive end to the sub­stan­tive pro­ceed­ings," he said.

Rud­der de­scribed the press re­lease in the terms that it is draft­ed as "un­for­tu­nate and no doubt was pre­pared based on ad­vice from the First Claimant’s At­tor­neys."

Rud­der al­so ad­vised Leonce's at­tor­neys that the de­tails of the ad­ver­tise­ment would be made known to the pre­sid­ing judge, Jus­tice James Aboud.

“This con­duct from your clients is un­for­tu­nate and ill-ad­vised. It is not how lit­i­ga­tion should be con­duct­ed," Rud­der said.

Guardian Me­dia is al­so weigh­ing its le­gal op­tions.

The list of charges is as follows:

• Michael Carew— On April 16, 2012, at RBC Bank, Starlite Shopping Centre, Diego Martin, received the sum of TT$850,000, being a transfer from an RBC Roytrin Mutual Fund held in the name of The Calabar Foundation to his RBC account, knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T.

—August 11, 2017 at the TT Unit Trust Corporation, Independence Square, received $1, 896,649.84, the proceeds of RBC Royal Bank Limited cheque number 0711307, dated 11 August 2017, knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T.

• Michael Carew and Victor McEachrane

On September 9, 2010, at RBC Bank Starlite Shopping Centre, Diego Martin, they received sums totalling $575,000, being the proceeds of Government cheque #P00236829 dated May 12, 2012, payable to the Calabar Foundation in the sum of $375,000; and the Government of T&T cheque #00236828 dated May 12, 2010, payable to Calabar Foundation in the sum of $200,000, knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T.

• Edgar Zephyrine, Marlene McDonald, Michael Carew and Victor McEachrane

On diverse days between 8 November 2007 and 5 December 2013, conspired together to defraud the State of TT$800,000 by corruptly procuring for their benefit and enrichment funding in the sum of TT$800,000 to be purportedly used by an entity called The Provident Foundation for Development, towards undertaking a radical programme of education, skills enhancement and business development in a number of the poorest communities within T&T.

• Marlene McDonald, Michael Carew, Victor McEachrane

On the diverse days between the period March 31, 2010 and September 10, 2010, in Trinidad, it is conspired together to defraud the State of T&T of $375,000 by falsely pretending that (I) a body purporting to be the Calabar Foundation was a genuine charitable foundation and (II) that a request for funding in the sum of $375,000 made to the body purporting to be the Calabar Foundation was to be used for the infrastructural works at #10 Ariapita Road, St Ann’s, those premises purported to be owned by the Calabar Foundation

• Edgar Zephyrine and Michael Carew

It is alleged that on 14 July, 2010 at First Citizens Bank Independence Square, Port of Spain branch, received the sum of $800,000 in whole, being the proceeds of First Citizens Bank Limited Independence Square Port of Spain branch manager’s cheque #117613 dated April 12, 2010, made payable to The Provident Foundation for Development, knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T.

• Wayne Anthony and Victor McEachrane

—It is alleged that on August 16, 2010, at RBC Royal Bank Trincity Mall branch, received $160,000, being the proceeds of a First Citizens Bank Limited manager’s cheque dated August 10, 2010, made payable to Water Wheel Foundation B/O The Provident Foundation for Development, knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T

Knowing or having reasonable grounds to suspect that the money was criminal property and constituted the benefit of criminal conduct, namely conspiracy to defraud the Government of T&T, is alleged that Zephryine: -On February 4, 2013 at First Citizens Bank Independence Square branch, received the sum of TT$19,500, being the proceeds of an electronic transfer made from First Citizens bank account held in the name of The Provident Foundation for Development.

-On August 10, 2010, at First Citizens Bank Independence Square disposed of TT$160,000.

-On December 21, 2012, at First Citizens Bank Independence Square, Port of Spain Branch, received $30,000 being the proceeds of an electronic transfer made from an First Citizens account held in the name of The Provident Foundation for Development.

-On October 23, 2013, at First Citizens Bank St. James Branch, received $22,000, being the proceeds of an electronic transfer made from an First Citizens account held in the name of The Provident Foundation for Development

-On September 12, 2013, at First Citizens Bank St James Branch, received $15,000 being the proceeds of an electronic transfer made from a First Citizens account held in the name of The Provident Foundation for Development.

-On June 24, 2013, at First Citizens Bank Limited St. James Branch, received $10,000, being the proceeds of an electronic transfer made from an First Citizens account held in the name of The Provident Foundation for Development

-On May 21, 2013, at First Citizens Bank Limited St. James Branch, received the sum of $12,000, being the proceeds of an electronic transfer made from a First Citizens account held in the name of The Provident Foundation for Development.

Edgar Zephyrine leaves the Port-of-Spain prison after accessing bail on Wednesday.

Af­ter spend­ing two nights at the Port-of-Spain Prison, Edgar Zephyrine who was joint­ly charged with for­mer Pub­lic Ad­min­is­tra­tion Min­is­ter Mar­lene Mc Don­ald and three oth­ers was able to se­cure his $1 mil­lion bail and walk out the prison short­ly af­ter 1 pm Wednes­day.

Zephyrine, along with Michael Carew, Vic­tor Mc Eachrane and Wayne An­tho­ny faced charges of mon­ey laun­der­ing and con­spir­a­cy to de­fraud the Trinidad and To­ba­go Gov­ern­ment.

Mc­Don­ald al­so faced sim­i­lar charges along with mis­be­hav­iour in pub­lic of­fice.

While Mc Eachrane se­cured bail on Tues­day and was re­leased from prison, Zephyrine, Carew and An­tho­ny spent a sec­ond night in jail.

Sources say Carew's and An­tho­ny's bail were al­so se­cured and they are ex­pect­ed to be re­leased from the prison short­ly.

Mc­Don­ald's lawyer Pamela El­der SC al­so con­firmed that her $2 mil­lion bail was se­cured.

How­ev­er, med­ical sources told Guardian Me­dia up to 1:30 Wednes­day af­ter­noon, no in­struc­tions had been giv­en to dis­charge Mc­Don­ald who re­mains at the in­sti­tu­tion.
