you cant upgrade directly to win 10 from XP but you can upgrade indirectly.
win xp -----> windows7 ---->free upgrade to windows 10

The consumer free upgrade offer for Windows 10 applies to qualified new and existing devices running Windows 7, Windows 8.1, and Windows Phone 8.1. Some editions are excluded from the consumer free upgrade—including Windows 7 Enterprise, Windows 8/8.1 Enterprise, and Windows RT/RT 8.1. Active Software Assurance customers in volume licensing have the benefit to upgrade to other Windows 10 enterprise offerings.
We have always been committed to ensuring that customers have the best Windows experience possible. With Windows 10, although non-Genuine PCs may be able to upgrade to Windows 10, the upgrade will not change the genuine state of the license. Non-Genuine Windows is not published by Microsoft. It is not properly licensed, or supported by Microsoft or a trusted partner. If a device was considered non-genuine or mislicensed prior to the upgrade, that device will continue to be considered non-genuine or mislicensed after the upgrade. According to industry experts, use of pirated software, including Non-Genuine Windows, results in a higher risk of malware, fraud (identity theft, credit card theft, etc), public exposure of your personal information, and a higher risk for poor performance or feature malfunctions.

How to turn your Windows 10 upgrade files into an ISO disk image
One question I've been asked more than any other in recent weeks is whether Microsoft will release Windows 10 in ISO format. No one outside Redmond knows yet, but in the meantime there's an option: Make your own ISO files. Here's how.

would i still get this when i do the upgrade since i read that bootleg copies would be upgraded with not problem
skylinechild wrote:simply put - for those too lazy to read
genuine windows 7 or 8 gets a genuine windows 10 already activated
hacked windows 7 or 8 gets a copy of windows 10 but it wont be activated - activation by paying for license ( they will give you a product key) or using a activation software ( crack)
Getting the final release on July 29th
Windows Insiders running the Windows 10 Insider Preview (Home and Pro editions) with their registered MSA connected to their PC will receive the final release build of Windows 10 starting on July 29th. This will come as just another flight. I’ve gotten a lot of questions from Windows Insiders about how this will work if they clean installed from ISO. As long as you are running an Insider Preview build and connected with the MSA you used to register, you will receive the Windows 10 final release build and remain activated. Once you have successfully installed this build and activated, you will also be able to clean install on that PC from final media if you want to start over fresh.

That's puzzling. I upgraded my (cough, cough) Windows 7 to Windows 10 and it's fully activated by Microsoft.
DTAC wrote:But Shogun it says "Windows is activated" yadda yadda yadda in the "This PC" properties box. Product ID and all shown
Wait. Windows 7 was fully activated. Even passed the Windows Validation Tool. But it was still you-know-what.

Aul updated the Microsoft blog post today to clarify things once and for all, and it’s bad news for freeloaders: you’re not getting an activated version of Windows 10 RTM (the final build) for free, unless you originally installed the Windows 10 Preview on a device running an activated copy of Windows 7 or 8.1.
