Forensic reports have confirmed that murdered Japanese pannist Asami Nagakiya was not sexually assaulted before she was strangled in the Queen’s Park Savannah last month.

Police sources working on the case told the T&T Guardian that samples sent for further testing abroad were returned last week and debunked suspicion that the 30-year-old had been raped and murdered.

The samples sent for testing also included oral swabs, which police said revealed some “very useful information” as they were awaiting analysis of DNA samples taken from suspects for comparison.

Nagakiya’s body, still dressed in her Legacy Carnival costume, was found around 9.30 am on Ash Wednesday (February 10) under a tree at the Queen’s Park Savannah by a homeless man. Nagakiya, a trained musician by profession and a tenor player with PCS Silver Stars, arrived in Trinidad on January 8 to participate in Carnival.

Homicide officers detained one man for questioning for three days before he was released while others gave statements to the police.

Investigations are continuing.

Clues to Asami's killer revealed

JAPANESE murder victim, Asami Nagakiya was strangled by a left hander and during the last minutes of her life she was bitten by her attacker who had bad teeth.

This was the conclusion drawn yesterday by Dr Valery Alexandrov during a lecture at the University of the West Indies, St Augustine campus where he spoke to students and tried to convince them to pursue forensic pathology as a career.

The lecture was facilitated by the Education Ministry and the The National Institute of Higher Education, Research, Science and Technology (NIHERST).

The theatre was packed as Dr Alexandrov showed graphic photos and cases he had investigated in Trinidad and Tobago and the Caribbean.

Alexandrov said he had to adjust to some cultural aspects of this country as a significant portion of the population cremated its dead.

The body of 31-year-old Nagakiya was found on Ash Wednesday 2016, under a tree in the Queen's Park Savannah.

She was wearing the Legacy costume that she played in on Carnival Tuesday.

There were injuries to her head, arms and legs, suggesting a struggle, and bite marks on her lips and cheeks.

Nagakiya's body was taken back to Japan and cremated. Her case remains unsolved and police claim it is still being investigated.

Alexandrov also chided lawyers who he said tended to save their clients from being convicted of murder by dragging out the cases and turning them into manslaughter cases by sometimes criminalising the victims.

He said: “The purpose of forensic pathology is to indicate the particulars of a case so as not to convert from murder to manslaughter.”

He cited an example of someone who shoots another person at close range or the torture of people before they are killed.

He said that the killer/s intent is solidified by the science of pathology so even if a defence attorneys says, “self defence,” a gunshot at close range or torture before death means that the killer was not defending him/herself and his or her intent was to murder.

Asami’s murder investigation at ‘advanced stage’

YESTERDAY marked two years since Japanese pannist Asami Nagakiya was strangled and her body dumped under a tree at the Queen’s Park Savannah.

The killing, which took place between Carnival Tuesday and Ash Wednesday 2016, has remained unsolved and police say the investigation has reached an “advanced stage” but offered no further information.

Her unsolved murder has crippled her countrymen with fear and many of them have stayed away from the country this year.

Pan arranger Len ‘Boogsie’ Sharpe and Yoichi Watanabe, a Japanese who teaches music technology and audio engineering at the University of TT (UTT) told the Newsday that the number of Japanese pan players visiting this year have depleted compared to previous years. Prior to Asami’s murder, when her body was found in the savannah on Ash Wednesday in 2016, it was a common sight to see dozens of Japanese in the country, first to participate in the Panorama competition and then to play mas on Carnival Monday and Tuesday. In 2016, Asami played in the band All Stars. This year, only one Japanese national has been registered to play in Boogie’s Phase II Pan Groove pan side in the Panorama. Last year, two Japanese nationals visited TT for Carnival.

A close male companion of Nagakiya was questioned and released along with two women and another man. Nagakiya, 30, and the man were very close police said then and he was not a suspect but someone of interest in the killing. The two reportedly had a falling out over which Carnival band to play in on Carnival Monday but that was resolved by Tuesday.

Police said then when her body was first discovered it appeared that she had died of natural causes, as there was one small abrasion on her chin. However, 24 hours later, the marks of violence surfaced and it was clear that she was murdered.

Her autopsy concluded that she was manually strangled. Officers said around the woman’s neck and chest were several black and blue markings, suggesting she came to a violent end with little or no resistance, as she had no defensive wounds and beneath her nails there was no evidence of tissue from her killer.

Hhmmm so sad....I wonder if she knew the culprit?

They said she came to violent end with little to no resistence or was she jumped and preyed upon?

You know if we really cared about tourism we could have at least mustered the ability to solve this case given the fact that it was a foreign national. Never mind Setahal she was a local...but at least try to do something to give the appearance that we doing something or care about the foreigners.

I mean if only from a PR perspective for the TTPS....how slow can you be....can't you "fast track" the investigation we could do it for almost everything else.

The challenge here is that no eye witnesses means that there is nothing to go on.

DNA is only useful if there is something that you can compare it to.

This could be a foreigner that was on a plane before she was discovered...never to return.

It's sad...but there are unsolvable crimes.

Asami's case 'moving apace', police on search for killer of Japanese pannist
Jensen La Vende

FOUR years ago today, Japanese pannist Asami Nagakiya’s body was found in Queen’s Park Savannah, Port of Spain, on Ash Wednesday. Police are no closer to solving the case than they were in 2016.

A homeless man stumbled upon the 30-year-old among a pile of leaves and debris. She had on a Carnival costume.

The police Cold Case Unit is still investigating her death. "It is moving a pace," said a homicide detective.

Police believe Nagakiya was killed sometime between Carnival Tuesday (February 8) and Ash Wednesday (February 9) in 2016. She was last seen alive on Carnival Tuesday around 6.15 pm walking with a man near Picton Court, Newtown. The man and two women were questioned but were released without charge. An autopsy concluded she was strangled.

Her killer was left-handed and missing four to six front teeth, Russian forensic pathologist Dr Valery Alexandrov revealed in public lecture at UWI, St Augustine in 2017.

He lamented the length of time it took for her body to be taken to the Forensic Science Centre in St James saying "it was frozen" when he began the autopsy. He could not determine the time of death. However, he was able to build a profile of her killer referring to marks of violence on her neck from which he determined her attacker was left-handed. Bite marks on her cheeks showed that the attacker was missing a few front teeth. Ten suspects were cleared based on this information, said Alexandrov, who now works abroad.

Nagakiya's unsolved murder is just one of many unsolved murders women in TT which must not be ignored, Stephanie Leitch, founding director of Womantra, said when asked to reflect on the case.

“Not being able to bring Asami’s killer to justice is not unlike the lack of response or ability of the TTPS to bring to justice any of the perpetrators who have murdered women throughout these years,” Leitch said.

Womantra was at the forefront of a protest over the Port of Spain mayor, Raymond Tim Kee, who tried to link Nagakiya's death to Carnival culture, in comments about vulgarity and women's costumes.

“You have to let your imagination roll a bit and figure out was there any evidence of resistance or did alcohol control?” he told reporters at a press conference in 2016.

“It’s a matter of, if she was still in her costume – I think that’s what I heard – let your imagination roll,” he said.

Outraged Womantra and may critics called for Tim Kee's resignation which led him to step down. Tim Kee died last year.

Today, Womantra now has an online petition demanding that Government respond to gender-based violence. The petition, which can be found on change.org, had a target of 1,500 signatures – as of Saturday it had 1,215.

The six demands they have are: increased effectiveness, accountability and transparency of the State; sufficient financial and organisational support and resources; amending the Domestic Violence Act; establish a social fund to support NGOs; create a multi-stakeholder co-ordination mechanism to work together to end gender based violence and investing in social reformation programs to teach non-violent communication.

On January 21, the Gender-Based Violence Unit was launched. The unit will be manned by police specially trained to handle reports of domestic violence and similar acts of abuse and criminality.

This week, Nagakiya's name surfaced in Parliament when Opposition Senator Saddam Hosein spoke of her as one of the more than 2,000 people murdered in the past four years. He was piloting a private members' motion on Government's failure to deal with crime in the Senate on Tuesday.

"I speak on behalf of the victims of crime. The families of the thousands of citizens who have been brutally murdered," he said in a roll call of slain women, men and children.

He referred to Nagakiya as he highlighted tourists were also being attacked and murdered.

Nagakiya has been hailed a talented musician and pannist, embracing TT's culture which she shared with other musicians in Japan.

She played with several steelbands, where Japanese players could be seen ably executing their skills on the pan alongside experienced local players.

In a 2018 interview, Phase II Pan Groove arranger Len "Boogsie" Sharpe said Government should officially apologise to the people of Japan.

“No one has stood up yet and apologised to the Japanese people for what happened. They are such beautiful people...kind and humble,” he said. “Maybe the pan body or the Ministry of Culture should send an apology letter to them for what happened here..” Pan Trinbago dedicated a fund-raising concert to Nagakiya.

MEDIA RELEASE

TTPS Closes Case in Death of Asami Nagakiya

The Cold Case Unit of the Trinidad and Tobago Police Service (TTPS) has closed the case relating to the death of Japanese pannist, Asami Nagakiya.

Ms Nagakiya’s body was found in the Queen’s Park Savannah on February 10th, 2016. A post-mortem revealed that she was strangled. Following a review of the evidence on March 18th, 2021, Director of Public Prosecutions (DPP) Roger Gaspard expressed satisfaction that the investigation was thoroughly done. He concluded that all the evidence pointed to one suspect, DAVID ALLEN who was killed in a police-involved shooting on December 12th, 2016, in Woodbrook.

The DPP advised that the matter be closed.

Acting Deputy Commissioner of Police (Investigations and Intelligence), Mc Donald Jacob, expressed his appreciation to the Cold Case Unit of the Homicide Bureau in dealing with this matter.

He said the Cold Case Unit, which was formed to deal with old cases, will be continuing their quest to solve other outstanding cold cases.

Allen, 31, of Enterprise, Chaguanas, posed as a woman, complete with make-up and tight-fitted clothing, when he attempted to rob Stir Fry King Restaurant and Casino Pei Da Xiu, Ariapita Avenue, Woodbrook. However, he was confronted and shot in an exchange of gunfire with an off-duty police officer while attempting to escape.

In 2004, Allen, then 18, also disguised himself as a vagrant and attempted to rob a TSTT technician as he was leaving 51 Degrees nightclub at Cipriani Boulevard, Port-of-Spain. There was a struggle and the technician was shot in the stomach and later died at the Port-of-Spain General Hospital. He was charged with murder.

In 2012, Allen pleaded guilty to the lesser charge of manslaughter. The State accepted his guilty plea and he was sentenced to four years and six months for the offence, in addition to the eight years he spent awaiting trial.

Things are really wrong with our justice system.

I wonder who his lawyer(s) was/were?

So the state had evidence and did nothing for 10 months?
