Wouldn't the employer's Workmen's Compensation insurance cover a situation like this?

it would, if he has a policy and depending on if that policy also covers medical costs. many dont. many just cover compensation for loss due to injury.

sadly a lot of places in t&t have ppl working in some seriously hazardous & dangerous situations & dont even bother to look for a workmans comp policy. or even a basic health insurance policy to help employees in case of injury. it have thousands of ppl working as security guards, risking their lives daily, and the company they work for has absolutely nothing in place for their protection.

First off, report the accident to the OSH Agency via 623 OSHA, follow up call every week and take down the name of the person you speak to until and inspector calls you.

Next have the injured person write a statement and put it in writing so they will not forget the details as time passes memories blur. also include persons who may have witnessed the accident.

Thirdly do not sign any letters or notes from you employer accepting liability or compensation in any way. The only thing to take in terms of money is your salary. If you accept a lump sum payment your boss can argue that was full and final payment. If you need another surgery down the road the boss not paying for that.

Lastly be safe people.

question is what exactly is safe working and who is the judge of that ?
eg is a packer at supermarket packing boxes on shelves an unsafe job ?

also what are the legal requirements for a company to have separate private health insurance/workman's comp
so an employee can go to a private hospital of their choice ?

well some jobs put persons at greater risk than othe jobs. a security guard doing CIT work is more at risk for serious/mortal injury directly related to their duties than a shelf packer. defining & identifying occupational hazards isnt anything difficult.

as far as i know the only things to make employers & company owners look after their workers safety & get proper coverage for them are the workers themselves, whether individually or thru a union, or the if the emoloyer chooses to be proactive about it as a means of covering their own backside. so if sumn happens to an emoloyee while on the job due to a lack of training or hazardous working conditions that can be directly attributed to the management, the policy will settle it & it costs the company nothing more than the policy premium.
