What exactly are the distance restriction laws in Tobago?
Why can't they just be copied and applied in Trinidad...ESPECIALLY with the Jet Ski people?!?

Pilot still in custody
Girl dies after boat accident

Story Created: Jun 24, 2013 at 9:05 PM ECT
Story Updated: Jun 24, 2013 at 10:44 PM ECT
THE 21-year-old pilot of the boat that collided with a 14-year-old girl at Las Cuevas on Saturday, killing her, remained in police custody last night at Maracas Bay Police Station.
Around 5.30 p.m. on Saturday, a fishing pirogue was proceeding parallel to the shore at the same time that Lilly Blades, of Caven Crescent, Tacarigua, was swimming out to meet the rest of her group.
Blades, who was a third form pupil at El Dorado West Secondary School, was in the water about 25 feet from the shoreline when the pirogue came into contact with her, police said.
She was taken to Port of Spain General Hospital but even while en-route it appeared that she would not have survived her injuries, according to both the police and the lifeguards interviewed by the Express on Sunday. She was pronounced dead on arrival at the hospital.
Around 2 p.m. on Sunday, officers of the North Eastern Divisional Task Force arrested the suspect at his Las Cuevas home. The boat involved in the accident was also found tucked away in the Las Cuevas village. —GG

Dad recalls son’s accident
By Kim Boodram
Story Created: Jun 24, 2013 at 9:04 PM ECT
Story Updated: Jun 24, 2013 at 10:44 PM ECT
SIX years after his son, Yanik Quesnel, was confined to a wheelchair after being hit by a boat in Pigeon Point, Tobago, Bernard Quesnel has deemed it “sad” that regulations were not yet in place making it mandatory for people wishing to operate a boat to possess a licence.
Quesnel, in a telephone interview yesterday, spoke in the wake of the boating accident at Las Cuevas last Saturday, in which 14-year-old Lilly Blades was fatally struck by the propeller of a pirogue being driven by a 21-year-old fisherman.
Blades, a Third Form pupil at the El Dorado West Secondary School, was said to have been about 25 feet from shore and was in the process of swimming towards her group, when the boat, heading north and parallel to the shoreline, came into contact with her.
The pilot of the boat has since been arrested and remains in custody at the Maracas Bay Police Station.
Extending condolences to the relatives and friends of Blades on his family’s behalf, Quesnel said, “I can’t say that I share their grief because I still have my son, but I do understand some of what they are going through right now.”
Yanik Quesnel was 17 in 2007 when he and his girlfriend at the time, Ana Carolina Barry-Laso, then 16, who was visiting from her native Spain, were struck by a pirogue at Pigeon Point.
Both remained in critical condition for some time.
Yanik has since been in a wheelchair and still undergoing physical therapy in the hopes of one day being able to walk again. Barry-Laso is said to be coping, Bernard Quesnel said.
Yanik is also a student at the University of the West Indies (UWI), St Augustine Campus, where he is “doing well”.
“What I have to say now is much of what I had to say six years ago,” Quesnel said, “That it is only logical that regulations be in place for the operations of boats, much as they are for the operation of vehicles on the road.
“One should have a licence to drive a boat and at a certain age. And this would include such accessories as proper insurance, so that in the event of an incident, there is recourse.”
Quesnel said the young pilot of the pirogue that killed Blades should perhaps be made to engage in lengthy community service.
Quesnel said nothing appears to have changed since his son’s accident in spite of what should be some glaring practical steps to preventing further tragedy.
He said he was not yet sure, up to yesterday evening, whether his son had heard of Blades’s accident.

Anywhere else in the Caribbean requires a boat operators license? Or even any other island less than 5000km² in size.

Car drivers require licenses right, and they don't harm pedestrians obviously. right? :|
how exactly is a boat operators license a solution to the problem, instead of simply another form of taxation?

IT is not the first time this has happened and, unless proper preventative measures are put in place, it won’t be the last.
Last Saturday, at around 5.30 p.m., a pirogue ran over 14-year-old Lilly Blades while she was swimming in the Las Cuevas Bay. The impact killed her, and a 21-year-old fisherman has since been arrested. In 2011, a pirogue collided with a kayak in Scotland Bay, seriously injuring three persons, including a 13-year-old girl. And, in 2007, 17-year-old Yanick Quesnel was left paralysed after being hit by a pirogue while swimming at Pigeon Point in Tobago, with 16-year-old Ana Carolina Barry-Laso also being seriously injured.
These are only the incidents which have come to public attention. No doubt there have been many more near-hits and minor injuries which didn’t make the news. Anyone who has seen a pirogue ploughing through the sea waters can understand how such accidents occur. The design of such boats make their prow ride high, hence limiting the field of vision of the engine operator who sits at the back. There is supposed to be a second person at the front who signals the driver but that clearly isn’t always the practice, since some of these accidents would have been avoided if there had been an alert lookout in the bow. Moreover, many of these pirogue operators tend to speed so, even if they are warned by their lookout, they barely have time to react to danger.

So only two things need to happen to prevent such accidents. First, pirogues should not be speeding in any area where there are people bathing in the sea; and, second, there should be strict laws against persons with pirogues taking any route they choose when near to land. The Quesnel and Barry-Laso families had sued the Tobago House of Assembly (THA) and the Pigeon Point Heritage Park (PPHP), receiving a judgment in their favour in 2010. The THA has since appealed the decision.
But the judge awarded compensation to the injured young people due to several points. The THA and PPHP had failed to implement suitable measures to prevent watercraft from traversing a route which endangered sea-bathers near the shore. This included a failure to mark a route for water-craft, or to cordon off a safe bathing area, as well as a related failure to warn sea-bathers of the danger from such crafts.
The Quesnel case had highlighted clearly what should be done for all popular T&T beaches. Three years later, and two days after Lilly Blades’ death, the Ministry of Tourism, headed by Stephen Cadiz, issues a statement announcing that “immediate steps will be taken to further protect persons swimming at the beaches...”
Too late Mr Cadiz, too late.

because being a boat, it can't "sail" as you put it on the sand.

When last you went Mayaro and saw them pull in the nets? Ever see the amount of small fry they pull in and just leave on the shore? They get probably a bucket full of decent sized fish and the rest is just small fry that they kill. It's a miracle we still have fish in the ocean, because i have been seeing this nonsense for more than a decade now.

With respect to the accident, it is quite tragic. She was a friend of my friend, he spoke highly of her, apparently her bro and herself were really close. He was an avid swimmer and he had to pull her out after this happened. That kind of trauma stays with people for life. I hope they government actually implements some sort of legislation and enforce it to prevent this sort of thing from happening again.

There are responsible fishermen out there, sadly the majority are ignorant idiots who jus concerned with "makin ah dollah"
