Election petitions gets green light
Appeal Court rules in favour of UNC
Published: Monday, November 30, 2015
The Appeal Court in a majority ruling has paved the way for the United National Congress (UNC) six election petitions — challenging the Election and Boundaries Commission (EBC) decision to extend the voting time by one hour in Trinidad for the September 7 general election — to go full speed ahead.
The ruling means that the UNC will now have to provide cogent and credible evidence before a High Court judge to show that it was significantly disadvantaged and the EBC decision affected the results.
The PNM assumed office with 23 seats while the UNC retained 18.
Chief Justice Ivor Archie voted against the grant of leave while his colleagues, Allan Mendonca and Peter Jamadar, ruled in favour of the UNC. Both the EBC and the People’s National Movement (PNM) had challenged the decision of High Court judge Mira Dean-Armorer to approve the election petitions.
The UNC filed the election petitions for six constituencies—La Horquetta/Talparo, Toco/Sangre Grande, Tunapuna, St Joseph, Moruga/Tableland and San Fernando West within a week of its loss in the general election.
In its petitions, the party is claiming that the EBC acted illegally when it took the decision to extend the polls to 7 pm because of bad weather and traffic. The UNC also argued that the late notice was not properly communicated to voters.
The EBC denied any wrongdoing and is contending that it acted within its remit.

We now have a potential illegal government

It's not a matter of success.
It's to make sure that the EBC and the PNM Can't do as they please where the rule of law is concerned.

This is not a plan
It's about maintaining the rule of law.
This must never happen again. EBC and PNM Can not do as they please

This has nothing to do with rule of law. The fact is they're seeking an annulment of the election results in 6 marginals chief. If the shoe was on the other foot, there would be no rule of law argument. Nobody would have been going to the courts to verify the powers of the ebc. As i said, the numbers in 4 of the marginals are pretty damming, i can't see them securing an annulment but as i also said, stranger things have happened

It can happen to any other party
Possible 2016 ELECTION RESULTS (after irritating the electorate even more with Budget revelations)...
Sanctifier wrote:QUESTION: How come the extra hour for voting was only "illegal" in 6 marginal seats according to the UNC?...
If the"rule of law" excuse is valid for 6 marginals, then it should be true for ALL other constituencies in Trinidad... Not so?
With the UNC in disarray with old allies now open enemies... and the "late" COP like "used" toilet paper... the PM should call a snap Election if the UNC wins. There will never be a better opportunity to strengthen their position.Possible 2016 ELECTION RESULTS (after irritating the electorate even more with Budget revelations)...
PNM = 31... UNC = 10... Total PNM constitutional majority in Parliament...![]()
"Election defeat #6" for Kamla to stick in her chillum an' smoke!...
The best means of defence... is a strong offence!
UNC could lose out in election challenge
Published: Tuesday, December 1, 2015
The latest challenge to the Elections Results 2015 is expected by the losing party. As the calypso says, the winner always say that the Judges were right.
It is not my intention to decide if the Elections and Boundaries Commission was right or wrong in the interpretation of the law. I am not qualified to interpret the law, which is legal sense. But I do have a level head and common sense.
In my opinion, the EBC should have consulted the two main parties at the very least (three since the ILP nominated more than 21 candidates) and if possible, the Political Leaders of the other fringe parties. Consensus should have been obtained before announcing the one-hour extension because the PNM or UNC (who-ever is the loser) would be expected to challenge the results. Instead, the EBC acted on its own (or so we think) and we now have a legal challenge that will be expensive to the taxpayer. We are now at the stage of the legal battle that will be drawn out and again I repeat, expensive to the taxpayer. The UNC is challenging the results in six constituencies:
Moruga/Tableland Margin of 533 = 2.5% of voters
St Joseph Margin of 1633 =8.4% of voters
La Horquetta/Talparo margin of 2815 =15.6% ofvoters
San Fernando West margin of 3310 = 19.6% of
voters
Tunapuna margin of 3615 = 19.2% of
voters
Toco/Sangre Grande margin of 3904 = 19.4% of
voters
Using the principle of level head and common sense, the average hourly vote in twelve hours is 8.33% and it is not expected that more than 16.66% of voters will be present in that last extra hour. Otherwise there will be a long line after 07.00pm. But each will have their opinion.
In the end the courts will first have to decide if the EBC had the right to extend the Elections 2015 by one hour. If the Courts decide that the EBC does not have such right, then all seats with a margin of victory of less than 3904 votes and won by the UNC must also be declared null and void. These seats include:
Barataria/San Juan—540
Chaguanas East— 1424
Pointe-a-Pierre— 1506
Mayaro— 2894
Cumuto/Manzanilla—3179
Fyzabad— 3802
The High Court must fast-track the decision and bring this to quick end.
