The United National Congress (UNC) has crossed the first hurdle in its challenge of the Elections and Boundaries Commission’s decision to extend last Monday’s general election voting by one hour due to rainy weather. Lawyers representing the UNC, which lost the election to the PNM 23-18, last night received leave to pursue their petitions from High Court Judge Mira Dean-Armour after an emergency hearing in the Port-of-Spain High Court which ended after 7 pm.

Media personnel were not allowed in the court for the hearing, which was attended by unsuccessful UNC candidate for Toco/Manzanilla Brent Sancho and EBC chairman Dr Norbert Masson. In a brief interview after the case, attorney Wayne Sturge claimed the result vindicated former prime minister and UNC political leader Kamla Persad-Bissessar, who first took issue with the EBC’s decision after her party’s election defeat.

“This is a slap in the face of those who believed that it was frivolous and vexatious. This shows that the rule of law prevails and in due course we will get our justice,” Sturge said. Given Dean-Armour’s ruling, the lawyers will now have to file the petitions and will then have to wait for a date for the case to be heard.

“We feel that given past experience this is something that is dealt with expeditiously. We think it should be dealt with in the space of nine months,” Sturge said, adding that the eventual decision on the petitions could only be appealed to the Court of Appeal and not to this country’s final court, the United Kingdom-based Privy Council. The UNC was also represented by Gerald Ramdeen. The EBC was not represented by any attorneys during the hearing, which was held ex-parte.

The UNC is claiming that the EBC’s rules and the Constitution give the EBC only the power to adjourn an election in instances of public violence and not the power to extend the traditional election timeframe of 6 am to 6 pm. The party is seeking to have the court declare the results in six marginal constituencies null and void. The disputed constituencies are San Fernando West, La Horquetta/Talparo, Toco/Sangre Grande, Tunapuna, St Joseph and Moruga/Tableland.

In the event the party is successful the court may order that by-elections be held or may possibly rule that a declaration that the EBC breached its powers be granted. Responding to the UNC’s initial threat of the petitions last week, the EBC defended its position and said that section 71 of the Constitution gave it autonomy to manage the registration of voters and the conduct of the election in an unfettered manner.

"The United National Congress was today granted leave to file 6 election petitions to challenge the validity of the election process in 6 critical constituencies namely:

· La Horquetta/Talparo
· Tunapuna
· St. Joseph
· Toco/Sangre Grande
· San Fernando West
· Moruga/Tableland

Senior High Court Judge Madam Justice Mira Dean- Amourer made the order granting leave in all 6 matters at around 7pm in a special late night sitting of the High Court at the Hall of Justice in Port of Spain. The order granting leave certifies there is merit in the petitions and that there is a serious issue to be tried. If the case is without merit, leave will be refused.

The issue in this case is whether the EBC acted illegally and in breach of the constitution when it extended the voting time from 6pm- 7pm on Election Day.

The sudden decision of the EBC to extend the voting time caught many by surprise and led to chaos and confusion. Legal letters were written to notify the EBC that candidates were receiving numerous complaints from voters who were turned away from the polls, when they went after 6pmto cast their vote because the EBC officials were themselves unaware of the EBC's decision to extend the voting time.

It was reported in the Trinidad Guardian Newspaper on September 8th 2015 in a story entitled "T&T Starts New Era under the PNM" that the PNM had asked the EBC to extend the voting time. There has been no denial or refutation of this significant statement by the EBC. The UNC was never informed that such a request was made. The UNC was never officially informed by the EBC of its decision to extend its time for voting.

We therefore call upon the EBC to state publicly whether the PNM did in fact make such a request. If such a request was made, we asked that there be full and frank disclosure in the following:

Ø When was the request made?

Ø What time was it made?

Ø Who made the request?

Ø To whom was it made?

Ø How was it made?

Ø Why was no other political party or candidate informed of this request?

Ø When did the EBC meet to consider this request?

Ø Why was it approved?

These are important searching questions which the EBC must answer to the population left our democracy be distorted and thwarted. It was patently unfair to change the rules of the election and shift the goal post so close to the final whistle. It is important that the constitution be protected from any abuse of power and hence we are pleased that the High Court has seen it fit to grant leave so that clarification can be provided on this important issue which strikes at the very heart of our democracy. The UNC was represented by Former Attorney General Anand Ramlogan SC, Wayne Sturge, Gerald Ramdeen and Kent Samlal."

wait... the Minority Leader Kamla throws veiled barbs at a former Independent Senator in her Opposition Leader Speech talking about hiding behind a mask of Independence then turns around and names the freshly departed Speaker of the House as a Senator? Did Kamla know Mary King was an Independent Senator? Did she comment on former (briefly) Independent Senator Dr Kriyaan Singh's comments about Dr Rowley the day after elections when he equated same with a dog? How about taking a judge off the bench and onto the election podium? She really should STFU

and there it is. the ex speaker who cover for kamla and then kamla cover for open and in public view. i thought the speaker was supposed to be neutral. but all the signs were there that he was a member of the unc bought and sold since he was speaker. now they have nothing she had to give him a position for all he do to protect she from the speaker seat.

The People’s National Movement’s fourth leader, Dr Keith Rowley, now Prime Minister-elect, will be T&T’s second Tobago-born Prime Minister following yesterday’s 2015 general election victory.

Rowley follows Tobago-born late Prime Minister Arthur NR Robinson into history in this regard.

Mammoth cheers from supporters went up at PNM’s Balisier House headquarters at 11.40 pm last night when PNM chairman Franklin Khan announced the party’s election result victory, adding: “I now invite to address you, the new Prime Minister of T&T.”

Speaking to the media just before the announcement, Rowley had said: “We have been tracking these results and the PNM would have won the elections and from tomorrow (today) T&T will have a new government...the PNM has come out with the majority of seats...tonight is the beginning of another era.”

Rowley said the PNM had won 22 or 23 of the 41 constituencies. Results for the Moruga Tableland constituency were still incoming when he spoke.

Later on it was unofficially announced that the PNM had taken the election 23-18, pending the official release of that information by the Elections and Boundaries Commission.

The PNM takes the helm from the People's Partnership, which now forms the Opposition, with 18 seats and which won the popular vote despite the PNM’s win in the majority of constituencies.

The PP crossed 300,000-plus votes while the PNM received 200,000-plus, it was estimated.

Outgoing prime minister Kamla Persad-Bissessar conceded at midnight at her Siparia office, speaking after Rowley made his victory speech. She said the people’s wishes must be respected as the people had chosen.

Sounding upbeat throughout her speech, she added: “I’m happy to be Citizen Kamla, MP for Siparia, all over again. I believe we fought a good fight.”

Persad-Bissessar noted the PP had obtained the popular vote. She said she would not stop serving the people, that the PP was still strong and that there would be healthy Opposition in the Parliament,

Congress of the People leader Prakash Ramadhar also said he hoped Rowley was sincere. He said what politicians did hereon would determine how successful T&T would be.

Jack Warner’s Independent Liberal Party (ILP) lost its bid in all the seats it contested, even though Warner at the close of polls had projected his party might have won “one to three seats.”

But the United National Congress’ Ganga Singh re-took the Chaguanas West seat which Warner held from 2010 to yesterday — in and out of government — and Warner also lost his bid for Chaguanas East, which was won by UNC’s Fazal Karim.

Warner told reporters that was his last hurrah in politics during his concession speech at the party’s Chaguanas headquarters last night. (See Page A8)

The seats which gave the PNM its election victory were St Joseph, Toco-Manzanilla, Tunapuna, La Horquetta-Talparo and San Fernando West, apart from its traditional constituencies.

The PP maintained its traditional holdings, with the UNC taking 17 seats and COP leader Ramadhar winning the St Augustine seat, a total of 18.

Inclement weather throughout all of T&T marred yesterday’s exercise, though heavy voting patterns with a continuous flow of voters was seen all morning in polling stations.

Rains which began mid-morning and continued to late evening prompted the PNM to seek to have the EBC extend the close of poll time from 6 pm to 7 pm in Trinidad, though not Tobago.

This was the second time since 1961 that the close of poll deadline was extended from 6 pm to 7 pm. It was last done in December 1961 due to problems with voting machines.

Long campaign

After the long three-month campaign period of the 2015 general election ended yesterday, trends began emerging around 9 pm, with the PP leading in 19 seats and the PNM in 16. By 9.20 pm the PP was leading in 21 seats and the PNM in 18.

At that time it became clear that Toco-Manzanilla, Tunapuna and St Joseph were in the balance.

At 9.30 pm the first two seats to be declared went to the PNM: Tobago West (Shamfa Cudjoe) and Tobago East (Ayanna Webster-Roy).

By 10 pm, Siparia was declared for PP’s Persad-Bissessar, who received over 15,000 votes. She thanked supporters for her victory there.

However, by 10.30 pm, the numbers flipped and the PNM surged ahead in La Horquetta-Talparo, St Joseph and Tunapuna.

The final declarations came at just after 11 pm. By that time, PNM supporters at a crowded Balisier House, Port-of-Spain, had started celebrating while disappointed PP supporters at Rienzi Complex, Couva, had started to leave when Persad-Bissessar failed to show up.

Rowley, during his victory statement, again warned that difficult times were ahead. He said his first priorities were the swearing in of an attorney general, whom he declined to identify, and the delivery of the 2016 Budget.

EBC spokesman Dominic Hinds said last night they couldn’t give a voter turn-out until around noon today. He also said figures were preliminary.

The 2015 electorate was 1,099,279. In 2010 voter turnout was approximately 69 per cent of the 936,236 electorate.

Wade Mark was UNC before....since Panday's time.....provided the Speaker in office is impartial, wht de problem?

THE UNITED NATIONAL CONGRESS PRESS RELEASE

"The United National Congress was today granted leave to file 6 election petitions to challenge the validity of the election process in 6 critical constituencies namely:

· La Horquetta/Talparo
· Tunapuna
· St. Joseph
· Toco/Sangre Grande
· San Fernando West
· Moruga/Tableland

Senior High Court Judge Madam Justice Mira Dean- Amourer made the order granting leave in all 6 matters at around 7pm in a special late night sitting of the High Court at the Hall of Justice in Port of Spain. The order granting leave certifies there is merit in the petitions and that there is a serious issue to be tried. If the case is without merit, leave will be refused.

The issue in this case is whether the EBC acted illegally and in breach of the constitution when it extended the voting time from 6pm- 7pm on Election Day.

The sudden decision of the EBC to extend the voting time caught many by surprise and led to chaos and confusion. Legal letters were written to notify the EBC that candidates were receiving numerous complaints from voters who were turned away from the polls, when they went after 6pmto cast their vote because the EBC officials were themselves unaware of the EBC's decision to extend the voting time.

It was reported in the Trinidad Guardian Newspaper on September 8th 2015 in a story entitled "T&T Starts New Era under the PNM" that the PNM had asked the EBC to extend the voting time. There has been no denial or refutation of this significant statement by the EBC. The UNC was never informed that such a request was made. The UNC was never officially informed by the EBC of its decision to extend its time for voting.

We therefore call upon the EBC to state publicly whether the PNM did in fact make such a request. If such a request was made, we asked that there be full and frank disclosure in the following:

Ø When was the request made?

Ø What time was it made?

Ø Who made the request?

Ø To whom was it made?

Ø How was it made?

Ø Why was no other political party or candidate informed of this request?

Ø When did the EBC meet to consider this request?

Ø Why was it approved?

These are important searching questions which the EBC must answer to the population left our democracy be distorted and thwarted. It was patently unfair to change the rules of the election and shift the goal post so close to the final whistle. It is important that the constitution be protected from any abuse of power and hence we are pleased that the High Court has seen it fit to grant leave so that clarification can be provided on this important issue which strikes at the very heart of our democracy. The UNC was represented by Former Attorney General Anand Ramlogan SC, Wayne Sturge, Gerald Ramdeen and Kent Samlal."

The People’s National Movement’s fourth leader, Dr Keith Rowley, now Prime Minister-elect, will be T&T’s second Tobago-born Prime Minister following yesterday’s 2015 general election victory.

Rowley follows Tobago-born late Prime Minister Arthur NR Robinson into history in this regard.

Mammoth cheers from supporters went up at PNM’s Balisier House headquarters at 11.40 pm last night when PNM chairman Franklin Khan announced the party’s election result victory, adding: “I now invite to address you, the new Prime Minister of T&T.”

Speaking to the media just before the announcement, Rowley had said: “We have been tracking these results and the PNM would have won the elections and from tomorrow (today) T&T will have a new government...the PNM has come out with the majority of seats...tonight is the beginning of another era.”

Rowley said the PNM had won 22 or 23 of the 41 constituencies. Results for the Moruga Tableland constituency were still incoming when he spoke.

Later on it was unofficially announced that the PNM had taken the election 23-18, pending the official release of that information by the Elections and Boundaries Commission.

The PNM takes the helm from the People's Partnership, which now forms the Opposition, with 18 seats and which won the popular vote despite the PNM’s win in the majority of constituencies.

The PP crossed 300,000-plus votes while the PNM received 200,000-plus, it was estimated.

Outgoing prime minister Kamla Persad-Bissessar conceded at midnight at her Siparia office, speaking after Rowley made his victory speech. She said the people’s wishes must be respected as the people had chosen.

Sounding upbeat throughout her speech, she added: “I’m happy to be Citizen Kamla, MP for Siparia, all over again. I believe we fought a good fight.”

Persad-Bissessar noted the PP had obtained the popular vote. She said she would not stop serving the people, that the PP was still strong and that there would be healthy Opposition in the Parliament,

Congress of the People leader Prakash Ramadhar also said he hoped Rowley was sincere. He said what politicians did hereon would determine how successful T&T would be.

Jack Warner’s Independent Liberal Party (ILP) lost its bid in all the seats it contested, even though Warner at the close of polls had projected his party might have won “one to three seats.”

But the United National Congress’ Ganga Singh re-took the Chaguanas West seat which Warner held from 2010 to yesterday — in and out of government — and Warner also lost his bid for Chaguanas East, which was won by UNC’s Fazal Karim.

Warner told reporters that was his last hurrah in politics during his concession speech at the party’s Chaguanas headquarters last night. (See Page A8)

The seats which gave the PNM its election victory were St Joseph, Toco-Manzanilla, Tunapuna, La Horquetta-Talparo and San Fernando West, apart from its traditional constituencies.

The PP maintained its traditional holdings, with the UNC taking 17 seats and COP leader Ramadhar winning the St Augustine seat, a total of 18.

Inclement weather throughout all of T&T marred yesterday’s exercise, though heavy voting patterns with a continuous flow of voters was seen all morning in polling stations.

Rains which began mid-morning and continued to late evening prompted the PNM to seek to have the EBC extend the close of poll time from 6 pm to 7 pm in Trinidad, though not Tobago.

This was the second time since 1961 that the close of poll deadline was extended from 6 pm to 7 pm. It was last done in December 1961 due to problems with voting machines.

Long campaign

After the long three-month campaign period of the 2015 general election ended yesterday, trends began emerging around 9 pm, with the PP leading in 19 seats and the PNM in 16. By 9.20 pm the PP was leading in 21 seats and the PNM in 18.

At that time it became clear that Toco-Manzanilla, Tunapuna and St Joseph were in the balance.

At 9.30 pm the first two seats to be declared went to the PNM: Tobago West (Shamfa Cudjoe) and Tobago East (Ayanna Webster-Roy).

By 10 pm, Siparia was declared for PP’s Persad-Bissessar, who received over 15,000 votes. She thanked supporters for her victory there.

However, by 10.30 pm, the numbers flipped and the PNM surged ahead in La Horquetta-Talparo, St Joseph and Tunapuna.

The final declarations came at just after 11 pm. By that time, PNM supporters at a crowded Balisier House, Port-of-Spain, had started celebrating while disappointed PP supporters at Rienzi Complex, Couva, had started to leave when Persad-Bissessar failed to show up.

Rowley, during his victory statement, again warned that difficult times were ahead. He said his first priorities were the swearing in of an attorney general, whom he declined to identify, and the delivery of the 2016 Budget.

EBC spokesman Dominic Hinds said last night they couldn’t give a voter turn-out until around noon today. He also said figures were preliminary.

The 2015 electorate was 1,099,279. In 2010 voter turnout was approximately 69 per cent of the 936,236 electorate.

Needed: A fresh start for the UNC

It is not inconceivable that the United National Congress could experience a measure of erosion to its tribal base support into the future.

And this would be especially so, if the present leadership of the party does not come around to the realisation that it has failed.

That it has not been able to accomplish the unwritten promise in this competitive political environment that it would stay in office to assure the community of being at the top of the political, cultural, social and economic heap.

Undoubtedly, the strength of the UNC support base in business, the professions, finance and other material elements of the culture will be sustained whichever party is in power. Indeed, it is worth noting that the platform from which the economic ascendancy of Indo-Trinidad was laid during the periods of PNM being in power.

The fact is that unlike Afro-T&T, Indo-Trinidad took advantage of the opportunities for education and applied their cultural instincts for business in a society that has been free, open and accommodating to honest effort.

That having been said, the reality is that the UNC/People’s Partnership amalgam has lost five elections under the present leadership of Kamla Persad-Bissessar and her associates.

It must strike elements of the UNC support base that the leadership of the party took no real notice and lessons out of the first four defeats and continued to operate on the same outmoded political model, which I described last week as Anansi Politics, designed to fool and seek advantage based on outmoded notions of political mobilisation and reliance on tribal instincts at the poll.

The electoral map depicted on television on election night showed that the protected areas of UNC support held through the voting; and that has been the historical pattern whatever the state of the politics. However, the numbers of the Elections and Boundaries Commission show that whereas the UNC received 308,581 votes in the 2010 poll, that figure was reduced in 2015 to 290,000 votes approximately, a slippage of nearly 20,000.

Now those are the raw figures and it would take some digging through the numbers to find out if the 20,000 and others slipped away from the UNC core base, or whether they were new comers who became quickly disenchanted over the last five years.

If there is going to be a measure of erosion from the UNC base it is more than likely to come first from the Indo-Trini social middle and business classes.

They are the ones with business and other interests to serve. If they are comfortable and prosperous with the policies and programmes of Dr Rowley’s government, they may trade those benefits for tribal instincts.

That would likely to be more possible if the present UNC leadership remains stuck in the old mould awaiting tribal instincts to activate the base.

As difficult as it may seem, Persad-Bissessar, Moonilal, Rambachan and others who now hold the sentiments of the tribe, could wake up to the reality that the political and social ideology they have pursued for so long is in need of transformation.

The reality is that the demographics and sociology of the entire society inclusive of the Indo-Trini population are changing. Soon enough changes are going to come to Rudder’s insightful observation that “how we vote is not how we party.”

What however is needed is for a fresh start to the UNC. This would require a change in the leaders and ultimately a new beginning in political philosophy and ideology as a means of mobilisation, including the end to “smart-man” politics.

It is quite unlikely that the leadership and supporters of the UNC would take on what this columnist says; they should however critically examine how the party fared in office, how the smart-man campaign imploded on them and they could come to the conclusion that change is at their doorstep.

As nearly impossible as it may have seemed then, the People’s National Movement under Patrick Manning made the first change; Dr Rowley renewed that change. Dynamism and growth even in political organisation and institutions can happen and are required if parties are to meet the needs of modern society.

Nuff said at this time about UNC politics.

All that has been experienced over the last five years of UNC/coalition meltdown should be lessons for the People’s National Movement. Even more required than economic transformation is quality governance. Indeed, it is quality governance that will manage and transform the economy; that will bring about social change and human development and will nurture into existence a new ethos in the society and polity.

Prime Minister Dr Keith Rowley talked the talk post and prior to being elected to office. “The buck stops with me,” he said after having his ministers sworn. He also promised on a number of occasions to be the prime minister of T&T. Dr Rowley also warned his ministers that they would soon be “ex-ministers” if they were to become embroiled in corrupt practices of whatever nature.

During the campaign, Dr Rowley also emphasised the organisational nature of the PNM as opposed to being a one-man band. As Prime Minister his government must demonstrate its organisational capacity and approach to governance and problem solving.

Chairman of the Board to oversee the operations of the Caribbean New Media Group (CNMG) and the Government Information Services Ltd (GISL), Helen Drayton, has hit back at Opposition Leader, Kamla Persad-Bissessar, for a thinly veiled verbal attack against her, saying her independence is exactly what caused her to land the job.
Drayton said sometimes people experience trauma when they lose “something of value” to them and there could be “hurt and disappointment”.

Those people deserve compassion and empathy, Drayton said.

Former president George Maxwell Richards, who Persad-Bissessar also made a thinly veiled reference toward, said her statements were “highly improper”.

On Monday, Persad-Bissessar received her letter of appointment as Opposition Leader from President Anthony Carmona.

Moments after receiving her letter of appointment, Persad-Bissessar delivered a speech in which she seemed to take verbal jabs at Richards, Drayton and the Elections and Boundaries Commission (EBC) for separate recent issues.
