Illegal Signage - Court Win

Postby Sumana.00 » August 14th, 2014, 12:16 pm

The Ministry of Works and Infrastructure was successful in court recently after a Tunapuna Magistrate found a well-known company guilty of illegally advertising on the Ministry’s road reserves. The company was ordered to remove all illegal advertising in accordance with the Highways Act and Regulations. This victory comes on the heels of an ongoing illegal signage removal exercise being undertaken by MOWI’s Supplemental Police Unit.

Estate Constables attached to MOWI have been patrolling and removing all illegal signage and other paraphernalia placed on the Ministry’s Infrastructure at various locations across the country. In cases where persons and businesses continue to breach the law or ignore the warnings of the Ministry, Supplemental Police Officers have laid charges against them in several Magistrates Courts and those matters are pending.

The public is advised that it is illegal to place signs, advertisements, billboards, structures or any similar type of device on any of the following Ministry assets; traffic lights, medians, bridges, walkovers, road reserves, without prior written authorisation from the Ministry. Persons and organisations who engage in this activity are asked to desist immediately. Further, the public is advised that the Legal Unit is working towards amending our laws with a view to increasing the fines for persons or companies found guilty of this practice.

The illegal signage removal exercise is being carried out in the interest of road safety as these illegal advertising displays conflict with authorised traffic signs, are distracting to motorists and deface the property of the Ministry.

The MOWI needs to go and remove everything that is not supposed to be within its road reserves.

Too much ugly signboards on the highway. They should all be removed, even the ones on private lands.

Digital sign boards are the worse offenders, distracting drivers in the day and blinding at night.

What evidence is there to prove that the company advertised on the sign is responsible for placing the sign there?

Woh woh woh.... take it easy eh. You lookin to close down 95% of doubles vendors in the country or wat. I predict if they were to do that, there would be a sharp increase in unemployment and national hunger. This will affect the crime rate like unemployment and hunger always do. With increased crime rate, you will see increased gang presence. With increased gang presence there may be a rise in the popularity of gangster rap again. This would cause all dem youths dem to drop out of school to be gangsters where they will eventually shoot eachother in gang related incidents.

So please, keep the pavement doubles vendors.... think of the children

I'm guessing they will most likely initiate the legal process by placing a phone call to the advertised company. If the phone number is not on the sign, like it usually is, the company number can normally be found on facebook, website or yellow pages (most likely in that order). The officer will then converse with a company representative to ascertain whether the company itself is at fault or if the company contracted the expertise of an advertising company or individual.

If I see them coming I normally just put on my wipers and water jets and they get the idea.

But in case they don't, I do the same with my rear wipers when they walking past my car
